well kinda the other side said they did know it was on the books and didn't show up.so my lawyer had me go anyway and my lawyer and i sat in front of the judge one on one.my lawyer stated the issues of the other side playing game and told the judge he wanted mediation orderd so we can move forward.the judge order mediation and my lawyer picked a guy he wanted.then the judge told me that this is the best thing for me and as far as money goes i can get more this way then by him making a ruling.the judge was not happy the other side wasnt there and this was not the first time this has happened,so he did what my lawyer wanted with out a thought,he also said it was a complicated case with all that it involves.now my insurace that paid for the surgery has put there lawyer in the ring so they can get there money from wc,but the way i understand it is it will come out of my settlement,thats not good.that means i will lose money.i dont understand why wc shouldnt have to pay them directly and not out of my money.but this is what happened today and it has to be set in 30 day if not the judge will step in again and may make it bad for the other side.

Hurt, this is Common Practice, and if Your Attorney doesn't do this, or even Mention this to You, Please Speak to Him about this Before ANY Mediation. All of Your Expenses, (The Other Ins. Co. Surgery Cost, Outstanding Medical Bills, Deposition or any other Fees, etc.) should be Figured Out Long Before You go, and I'm going to Use an Example:
Let's say You want $200,000.00 and the Expenses are $35,000.00- You Ask for $250,000.00!! You See what I Mean? don't let them make a Settlement Offer and Then Subtract the Expenses, make Sure the Offer You make is High enough to Absorb the Expenses when they are Subtracted! Now if Your Attorney doesn't do, or can't Understand what You are Saying, kindly Excuse Yourself for a Moment, get Your Raised Golf Cart and Run His A** Over, and Find a New Attorney!!!
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |

hi still he is going to include all expenses in the settlement,but there is a lot of red tape in my case dealing with insurance and ltd company.i thought the wc would have to pay the insurance back before they figure my settlement,but maybe im wrong or our laws a different.then he had the rehab done because if they put me totally disabled i can possibly get 10 years of front wages but you lose back wages,that's no big deal,the 10 years is better and after ten years is up he can maybe get me another 3-5 years of wages.so there's a lot going on in this case and it will be a long day fighting over money.the judge was very nice and said if we don't settle this when he decides it will be all or nothing and that scared the h@ll out of me.so all i can do is hope my lawyer worked it well i thought and he said he was going to try to work it for see and he didnt beat around the bush with the judge.

Hurt,
I certainly wish you the best of luck with your settlement. Make sure you ask for enough like Still advised you. He is a smart person and has lot's of experience. I will be praying for you.
