appeal the unemployment decision. It's a ruse and a dodge by employer to avoid being charged.

I went through the same thing, never collected a penny from WC, was placed at MMI with restrictions, and my employer could/ would not, find me a job I could do, ( Big Joke) I was terminated after FMLA was up and only then could I collect unemployment. I had to use short term diss and my savings to live on. I was glad I had savings. but then I was already collecting retirement SS and so I just retired. I guess I was just lucky.

Yeah we are now out of savings and workmans comp is not paying so i now have an appoinment with one stop career center on friday. because of all my restrications I dont know if i can find a job that i can do

Do you by chance have any short term dis through your job? That might be worth looking into........ If you can't work because of being dissabled then maybe STD is a possable. as long as you are still employed by the company and they can't accomadate you.

I have already used the std last year but they wont let me use it anymore for the same problem. I just feel like I am stuck between a rock and and hard place. Why is it the state is for the employers not us that are trying hard to feed our kids and pay our bills. We did NOT ask to get hurt.

Whiteheadsr, it's a hard road to travel. Sometimes you feel everybody is fighting to make you suffer more and more. Companies fight for the laws that hurt us even more. It seems that no matter how good an employee is, once you get hurt you are the lowest life form to them.Try to keep your head up and remember we are not the bad people they want to make us out to be. It's hard, and other then the people on here, most just don't understand what it's like until they get hurt.

Please Speak with an Attorney that Deals with w/c Cases as soon as You Can. If You are on Restrictions, and Your Work has no Job within Your Restrictions MMI or not, at Least in My State, which is Pa., they have to continue giving You w/c Payments until You Either Settle, go through vocational Rehab and find Work, or find Work on Your Own! An Attorney can get You the things You are due, and Protect Your Rights, don't let them B.S. and step on You, Fight Back!!!!Wink

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!

Thank you guys very much. I actually just got off the phone with a lawyer. i will meet him next week. This is so crazy, i have never had to deal with stuff like this. I just dont think it is fair they can treat us like we dont matter, Like i told my boss i did not ask to get hurt I worked 6 days a week for her and now I am getting the run around. I had a feeling that was at least one of the reason that your employer was now actually firing your. That has happened to others from where I was working. I agree that if you haven't done so already, you really need to talk to a lawyer...esspecially since many are free to initially speak with. Go in with your questions already prepared, to make the best of your time with them. You can also talk with a EEO lawyer and see if they can help you. my co worker sued the company, for a different reason, but she did win her law suit. Well, in the sense that the company settleled and gave her a very nice early retirement package, not to come back, not to ever sue them again, and not to tell anyone the amount of money they gave her. So, I am wondering if you just talk with an EEO lawyer, when they realize it, maybey they will either give you a position that fits your restrictions or will let you go, so that you can get unemployment. I do not think they can continue to get away with not letting you go, but not giving you work either.
