Tx - Final impairment rating questions
My husband just received his final impairment rating of 7% for a accident that injured his arm back in March of last year. What we are wanting to know is who sets the $ amount what is mutliplied by the number of weeks. The state or the insurance company?

7 percent x 3 = 21 weeks times $ amount.

The formula including average weekly wage and maximum rate are set by Texas Law as enacted by the state legislature. see Sec. 408.041.

AVERAGE WEEKLY WAGE. (a) Except as otherwise provided by this subtitle, the average weekly wage of an employee who has worked for the employer for at least the 13 consecutive weeks immediately preceding an injury is computed by dividing the sum of the wages paid in the 13 consecutive weeks immediately preceding the date of the injury by 13.

Thank you for the quick response, but is this the same for the MMI? Is there a max $ amount on it like there is for the temporary Income payments. For temporay income payments even though the law states 70% of your salary, the max is 712.00?

The MMI is the same as IIBS. It is 70% of the TIBS. With that being said, lets ay that the tibs was $500.00. the IIBS would be $350.00 for 21 weeks.
