I agree with the attorney and also think you should apply for everything and any kind of help you can get. I would go directly to the puclic assistance office and apply for everything. That is the fastest way to get help. If they approve you for medical assistance you can then seek counseling. Trust me it's very necessary at times through a lenghthy WC battle.

I spoke to an attorney today and he is happy to take the case on. He has several cases dealing with the same ic. So that is good. He heard my situation and feels that I have a solid case. He felt that the wc are just trying to scare me off since I have had no attorney thus far. Well, I have one now. Also spoke to the surgeons office and was told that my surgeon has dictated a very severe letter off to the wc and asked the secretary to make sure I have managed to find an attorney. So the surgeon is on my side as well. Thank God, I don't feel too secure, and feel that I have a few hard weeks ahead of me. The attorney said that when they get the contest from my surgeon and then send everything off to their other doctor in Oregon, if his decisiion comes down against me........I will probably be cut off, so to be prepared. How I prepare for something like that I don't know. He is hoping to stave that off. Most of his cases are people who try to get more money out of the wc, so my case is something different.

I will get some sleep now, Hope things go ok tomorrow. I just hope I don't get too many more worries ahead............I am not sure I can deal with it all as it is.

You have won half the battle by having a good attorney and having a surgeon who is on your side. If the surgeon likes you, knows you have a legitimate injury and knows how WC insurance companies treat injured workers then that is a big positive for you. Hang in there, times might be rough for a while but you will do OK in the long run.

In my state, w/c can't cut off your benefits as long as your claim is in the appeal process. I suppose if and when the denial comes, you have a time frame (probably 30 days) to appeal and you have a very strong support from your surgeon to win your case.
Good luck and don't worry too much, many of us went through this and survived. Also try to educate yourself as much as you can how this appeal process works so you know what to expect.

Your attorney will take care of any appeals. Kat is right. Mine worked the same way. IC petitioned to stop my benefits, my attorney was right on it. They never stopped and I settled within 6 months. Limbo will be along and be able to give you the exact teminology for this. Keep in mind that when you have an attorney that he does everything not you. You shouldn't have any contact with anyone but your Dr. and attorney. And the IC should not be contacting you in any way once they knowyou have an attorney.

They will Probably Petition the Court for Superceadeus, which is Stopping Your Benefits either Based on the Medical Evidence of Their Dr., or for You not to be Paid during Litigation should Your Attorney Strike First! They Asked for Superceadeus 5 Times during My litigation, and the Judge would not Allow it, but Remember this is in Pa., but the Terminology May be the Same. They can try and Stop You Cold, but Your Attorney should be able to have You Re-Activated in a Matter of Days, by Sending an Emergency Request to the w/c Hearings System. My Best to You and Relax, if You Trust Your Lawyer, let them do the Worrying, and You do the Healing!! (That's what My Attorney Told Me, and it Works!!!Tongue)

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!
