mmmmmmmmmm as much as I would like to disagree with 1171 he is right my personal insurance started my care . wc was not taking care of my injury like I wanted to be cared for, my personal took care of it then THEY billed wc and they got their money before I got mine but I did get the medical care I needed MY LAWYER said get the care any way you can we will sort out the bills later....I did we did and all ended well....

Just someone who would hate to see another injured worker sent in a bad direction with their WC claim.

Jayne, as for your cliam I am pleased to hear that it worked out for you. Not in all states would you have faired so well. Most states specifically preclude one using personal health insurance policies to pay for WC claims, especially when the claim is accepted and being paid as Chrissy states her fiance's is. The issue they have, or at least as I read it, was they are not happy with the doctor that WC is paying for. In most states WC gets to choose the physicians that they pay for. Indiana WC is very specific that WC choses the docs. Also when one seeks treatment outside of the approved docs he has no assurance as to any of the other benefits being paid. Seems to be pretty high risk activity, wouldn't you agree?

that is what I paid my lawyer for he didnt steer me wrong and I came out ok.....WC while accepting part of my claim was slow to approve NEEDED surgery we called our personal IC they oked it then THEY went after the WC IC their response "this happens all the time,it is a shame what they put injured people thru"My personal IC called the WC IC told them it was a nessarry and doc approved and that they were gonna ok it and would go with us before the WC judge and let her know the wc IC was stalling and could cause even more injury....(which it did) they oked it with my doc within 24 hrs.......sometimes they gotta be gigged bt one of their own....

Thank you for explaining Jayne. That was a great exception that they made to help you. Hopefully Chirssy's fiance will meet with a similar response if that is the avenue they decide to take.

This is just all so confusing. We just wanted this to be done quickly and he would have had surgery last week had WC not decided to send him to another doctor. I don't understand why they are willing to pay for the first doctor's expenses...such as 2 visits and a MRI and then switch him to another and start all over. Meanwhile he sits at home off work and his employees are running the business because he can't even get around. I suppose the only good thing is his employer has said he will pay his full salary no matter what WC pays.

Chrissy, at least he has a decent employer. You would be surprised at what most ER's do to thier employees who file a WC claim, and then again maybe your wouldn't. Sounds like his ER is extraordinary to offer to make up his pay difference. Kind of restores faith in man kind to hear that.

Hope all goes well for you folks. BTW did he get his personal insurance to cover any or this like 1171 suggest you do? Just curious as I would like to know if this is allowed or not.

Good morning all.......Just my 2 cents. I am with Jayne and 1171 as I have experienced it first hand with my husband and myself. Personal insurance has paid for all hubby's medical for 3 years. The are in the process of getting paid back in full from WC IC. I have had to do the same thing. I have never seen it done any differently when and IW is denied quality, timely , necessary treatment. Good luck Chrissy in whatever you decide to do.

Chrissy, just my opinion, have him see the Co. Dr., I know this will slow things a bit.If that Dr. disagrees in any way with your current Dr. I would have the surgery done by my Private Insurance if the Dr. you chose say it's needed immediately or more damage will occur as Jayne and others have said. Then let the i/c's fight it out later! At least you did comply and have a visit with a w/c,i/c Dr. and later they can't hold that against you! I don't remember if you have a w/c certified Attorney or not, but if not, I would suggest one soon to double check what we've all told you. This system is the absolutely worst system I've ever seen and the name of the game in this w/c Hell is CYA (Cover Your A**)! I sure hope everything goes well, and he gets the care he needs!!Wink

Well seems I had nothing to worry about. My fiance had his doc appointment with the WC appointed doctor wed. He was set up for surgery yesterday (thursday) for a torn medial meniscus and is now sitting in the Lazee-Boy recovering. Everything went so much better then we expected. The doc was great...everyone at the hospital was awesome...now I just need him to get back to work and outta my hair! Wink Thanks everyone for your advice...I am happy we didn't really need it.
