settlement question/workers comp

I crushed my finger on a job back in april of 2007.I hired a workers comp lawyer who got a settlement agreement with the company I worked for at the time of the injury.


Last year my attorney sent me a $1900.00 check minus his 20% percent of the workers compensation.


I just settled my case with the companies attorney where I was injured and it was for $20,500.00 and I received minus the 20% percent.My attorney overnighted me the settlement papers to sign and on paragraph 4 of the settlement papers he says I have received $16,675.60 in workers compensation benifits which is simply not true.


I was told that he must have received the $16,675.60 and never let me know and kept it for himself.I was told my settlement is a totally different thing than my backtime workers comp benifits.


Workers compensation will not tell me if my attorney received the $16,675.60 on my behalf and told me to contact him.He wont answer take my calls nor return them nor answer my emails.



Could he have stole my workers compensation and what can I do?


Also the money in the setllement papers say I received $16,675.60 which I have not on paragraph 4 and then on paragraph 12 refers to the $20,500.00 which we agreed to settle on and which I just received.


I signed the papers not realizing it said I had received $16,675.60 and thought it was refering to the $1600.00 out of the over $1900.00n he received on my behalf.


I was told he has to send me a copy of all monies and letters exchanged between him and workers comp and the companies attorney where I was injured.

How can I get workers comp to see where the $16,675.60 went?

I need some advice.

I can not answere the question you have, but hopefully someone will be along that can. I do have one question, how much did the IC spend on medical????
8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom.

go to another lawyer and ask him to check out the paper work...it might cost you a hundred dollars but may net you a whole lot more....call the WC board and ask for copies of any and all monies sent to your lawyer......PM Timothy Belt on here he is a WC lawyer for Pa. he will understand more than we do.good luck

In the settlement papers it has I received $16,675.60 in benifits and my medical expences were over $7000.00 in my settlement papers.I called the medical facilities where I was treated and they say my bills total a little over $2000.00 a far cry from what my attorney claims.

My attorney is in the new orleans area in south louisiana and I am in the shreveort louisiana so for me to drive to my attorney would be over a 5 hour drive.I just cant see where he can say I received $16,675.60 in workers comp.All my benifits were sent to him for him to hold his 20% percent and the rest to me.True he received a little better than $1900.00 and he sent me a little over $1600.00 with a letter of explanation.He knows I have ADHD Disorder and clearly he has robbed me and workers comp.

I hope me signing the release papers will not help him get away with this crime.I still have not received copies of the monies he has received nor all correspondence between him and my workers comp adjuster.I have one letter he sent to them last year but no reponce letter he has clearly received and the $16,675.20 plus the over $7000.00 in my medical expenses he claims.

I think he would have to prove where he dispersed me the workers comp and where I signed to cash the $16,675.60 in the claim he says I have received and the proof of over $7000.00 in my medical bills which are in fact only a little over $2000.00

when I settled I had to go before a judge and my lawyer had all the paperwork there proving where each dollar went.....pick a lawyer in your town and have them read the paperwork
........I love cats, I just cant eat a whole one by myself......

My /mediation and court date was settled out of court.

OK, maybe you go this route. Call the attorney and tell him you want copies of all the records pertaing to your case and settlement. Then call the state bar association and talk to them and see what they have to say.

the issue may be something or may be nothing. I don't blame you for wanting to know. I would.

Thanks AQA.

The problem is he wont take nor return my phone calls.He wont answer my emails either.Also he says in my setllement papers that I have received $16,675.60 in workers comp bernifits which is a lie.The workers comp clearly sent him $16,675.60 and over $7000.00 in my medical expenses which was a little over $2000.00.


I dont know what to do except verify some way he has received the $16,675.60 in workers comp benifits.

Well then you know what needs to be done. Call the state bar association an see what they have to say.

Keep us posted on what happens. I believe people may learn from this.
