Try to make this short.....On 1-31-08 I went to the DR. my hip and back was hurting I hit my hip at home on the table they did and MRI found nothing except some minimal spinal stenosis in lower back. Took some anti-inflamitory pills everything was fine a month later, never went to the DR. about this again. I got in an accident at work on 12-3-08 went to the DR. cause my back and hip were hurting shooting pains down the right leg. They did an MRI found 2 bulged discs, and severe spinal stenosis. Now the WC insurance is trying to say that there was a previous injury. There is no pain in my hip now after the injury same type deal as before took some pills everything is fine, now my back that's different i'm seeing a specialist for it now. So what do I do, there may have been a previous injury to my hip but not my back as far a discs goes. Hope this makes sense.

The way I see it, there was a previous injury. I don't see it amounting to much. You said you had a MRI as a result of the first injury and another as a result of the accident. The difference in the MRI's should tell the story. Meaning, it will show how you were after the first injury versus the second.

aggravations are considered a new injury. a previous injury doesn't negate the new work injury especially if you've got a doctor's opinion (preferable the same one that saw you before) saying it's a new work injury. If they refuse benefits take them to the comp court.

My first injury was healed and 2 yrs later hurt same area again, aggravation of same disc's, It was considered a new injury. Good luck and if denied, I would consult with a good WC attorney.

Hi & Welcome!
You will most likely need the assistance or a good certified WC lawyer to hash things out for you and get the medical attention you need to heal. If you don't, WC will take advantage of the fact that you are uninformed about what your rights really are.

I would also seek an attorney's help. I injured my lumbar 3 xs , all work related. 2 xs it was the same disks, 1 time it was two others. All three times it was a new claim. I have since won, settled and retired.

It's my opinion if the Work Comp Insurance is still paying you, and your medical bills, is you don't have a problem.

Who is telling you that the Work Comp Insurance is trying to say that there was a previous injury?

If it's your employer or another employee, just don't say anything back about it, and brush it off.

Would also be a good idea if you provided us to what State this is in...RolleyesShy

I'm in nevada, and the WC sent me paperwork saying that there was a previous injury and they were getting medical records from my DR. that I saw a year ago. All I know is that my new MRI shows a lot more than the one from a year ago. Maybe i'm just getting all worked up for no reason.
