RE: Is the insurance company playing games?
Bummer...isn't it illegal to take a picture of someone without their permission. She doesn't have a license as a private investigator or anything like that. This just seems strange that someone could do that. Good luck to you. I have been reading this thread and hoping it all works out well for you. Love Red

Red & Sparkey
I do not know if it is illegal for her to take my picture, I will ask my attorney this week. It was the look on this person's face after she took the picture, it clearly said she was up to something. I have not been back to the store since this happened Wednesday, but really need to get some groceries in my house. Now I have the sednetary restrictions, I will take one of my children to help me with shopping. |

It's my opinion that the picture is useless. Without a proper order to have taken the picture, it can't be used for anything.

RE: Is the insurance company playing games?
Just my 2 cents. I agree with Sparkey, I would be pi$$ed. I probably would of confronted her also. We have enough to deal with in this wc mess, now we have to watch our backs with everyone? Like BBBB said, probably cant be used. This person just wants to try to get brownie points by their supervisor.

Jayne
I do wish that were the case. At the Early Childhood Center where I worked many of the children I worked with have graduated to elementary school and no longer attend. I did not work in the Infant/Toddler classroom so I do not know the younger children. It has been almost 3 years since I worked. Bad Boy, Thanks for the information. Caraven, I was so shocked when my picture was taken I didn't have a chance to be mad. |

RE: Is the insurance company playing games?
Jayne, That's a thought...
The mid to late 90's I went to this person and others in the department and requested staff inservice on the correct way to lift. I had seen young teachers with legs straight lifting children from the floor. I told my supervisor that someone, a child or teacher was going to get hurt. The person that took my picture voted down my request by saying it would be to expensive of an inservice. I was injured 7 years later. I was the 3rd of 4 teachers injured on the job in a 6 month period. All of the other teachers had minor injuries and were able to return to the classroom |

RE: Is the insurance company playing games?
Bummer Knees Wrote:Red & Sparkey It's not illegal for them to take a picture. And they could try to introduce it as evidence before a judge. Whether a judge would admit it is very doubtful. However, from my experience, first of all a still picture means nothing. Even a licensed PI that takes video means nothing if they can't show it was: #1 something you were saying you couldn't do. (Example, I had a PI send me video with a report how the person could bend at 90 degrees at the waist with no difficulty. He thought the case was made!! Yeah it helped alot. NOT!!! Since the injury was to the left knee.) #2 That it wasn't an isolated incident (I had a good day but then after that, I was in severe pain...) Everyone, no matter how bad they feel pain, sometimes does things out of necessity, or even without thinking once in awhle. And then suffers afterwards) Plus if it's a picture by an ex-coworker. They have a lot of burden of proof to even get it admitted. Most likely, the judge won't even consider it. The bottom line is.. If you have an injury that limits things you can do, if you are caught doing the things you say you can't do, you have a problem. If you are doing things that are not outside what the doctor says you can do and what you say you can do, you have done nothing wrong. Again, I'm not an attorney, but an ex-adjuster, I can't tell you the law or what is legal. Just what I've seen in my experience. |

RE: Is the insurance company playing games?
Well when I remember when the first phone that was able to take photographs came out that people were worried they were going to have their picture taken while standing in line paying for stuff etc. and invading their privacy. What ever happened to that???
I just feel I would of said something if I saw someone I use to work with taking my picture while I was out food shopping. I never had the fear of anyone watching me, and not one day goes by that I thinik of such a thing. I have a bad dominant hand and I know myself to not carry heavy stuff with that hand etc. When your in pain with that hand everyday you have nothing to worry about because you do use it to open a door ( out of habit ) but anything heavy goes on my other side to carry. Only because if not, I will regret it later with a bad pain level. carpal tunnel recurrence/ neuropathy / RSD. 1/29/07 injury date. Permanent. PIR settlement 8/4/08 10% |
