;)Workmans comp is not a road you want to travel alone. You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life, you have come out ahead of the game.....

RE: Still in limbo
Hi Everyone!! I have been on at Times to read, but My Pain continues to keep Me from Setting or Laying with the Lap Top, and My Concentration has been a Problem. Thank You All So Much for thinking of Me, I Miss You All, and Hope I can Build Myself up enough to Come back on more Often. I am also Dealing with a Bout of Pretty Deep Depression, and I'm not the Best at Being Cordial when I have to Deal with this, so it's Best for Me to Handle it with the Least amount of Human Interaction. I would never want to Lash Out at ANY of You! I Received My W/C Appeal Decision the Other Day, and even though I didn't Lose anything, I didn't gain Much Either. It was Remanded in Part back to the Original w/c Judge for Review of Specific Issues, which could Net Me some of My Attorney's Fees Back, but I am going to Have to go the State Level (Commonwealth Court) and Continue to Battle!! My Wages still aren't Correct, and We have Case Law to Back Us up, but with w/c in Pa. there are No Laws, they are Rules and Regulations that are Open to Interpretation by the Judges or Commissioners who Look at it, and Pa. has a Great Track Record of having the Commissioners and Judges bought by the Ins. Co.'s! Fortunately at the Commonwealth Level Law is Law, and not Open to Interpretation, only if it Applies to the Case at Hand! But My even Decision is Really a Great Win for Me, because the w/c Defense and the Employer have Lost at Both the Beginning Level, and also at the Appeal Level, so My Credibility, Medical Evidence, and Dr.'s Credibility Remain in tact, as it should. They Still have to Pay All Meds., Dr.Visits, and they can not Offer Me any More Jobs, Based on the Upholding of the w/c Judges Decision by the Appeals Board. So it a Win and a Loss, and with My Pain and Concentration Problems, along with the Depression, the Battle will Continue, but it will be Much Harder on Me! But as We All know, there is NO Emotion in the World of w/c as far as The Employer and the i/c's go, and at this Point I have been Fighting Strong and Hard for Over 4 Years Now, and I Will Continue until I get what I Deserve. As I said in the Very Beginning of My Case, I don't want ONE Penny More than I'm Entitled to, but I won't accept a Dime Less!! I better Go, this has taken about 1/2 Hour to Write and I'm Sore, but Remember I'm Still around, and Hope Soon to be around to Help Again!! I Still Owe Many People on Here My Help and Support, when I was a Newbie I was Taken In and Treated Like Family, and I Will Pass that on to Many Others Here!! My best for a New Year, and My Love and Prayers to You All!!
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |

RE: Still in limbo
Still,
Take care , don't push yourself or over-do. All will come together for you, You have been fighting a good fight, and with the grace of our good lord, all will be well. Come back when you can and when you are ready. Tuffy Life isn't about waiting for the storm to pass. It's about learning to dance in the rain. |

RE: Still in limbo
Still.... we are all here when you are able to come back and feel good. Still, you need now worry about lashing out at one of us, I believe we would all understand. People in general cope very differently with each situation. It's like I said to Del yesterday, I can always tell when he is having a high pain day because he is a little grumpy.... I understand that, and don't hold it against him... I have told you before if you ever said something that is out of your character to me, I would know immediately that you were not feeling well...and never hold that against you... you are a wonderful man at heart and only this pain that you endure keeps you from feeling like that wonderful man that you are. We are all here when you need to vent, yell, scream about the unfairness of it all..or just anything you want to say. You are in my prayers brother...love Red
