Hurt if the cobra was used to get care for your injury I think they should reimburse you...will they, who the hell knows.....if you were a union employee you may have even more clout than a non union as they were a big help to us....TEAMSTERS rock...

oh cap you did offend me in any way dont worry about that.i have some friends on the inside and i get info from them,im in good with some high up people and they tell me thing but i tell them nothing other then my condition as it gets worse.ya i dont know on cobra either but i have to trust my lawyer,i have been told he is one of the best in this state and his is brillant from what i hear.but i think a judge with be the person to straighten this all out i dont see wc ic doing the rite thing,but who knows they might.see ya all later.

The 2nd Insurance Carrier for me tried to settle mine, right before Christmas, and it was turned down with the speed of light. The 1st Insurance money is sitting idol, and I do know that amount of the settlement from them. Risk Management is holding that. I must settle both at the same time.

My advise, or opinion, is read everything, ask millions of questions, and don't rush it by any means. Just make sure everything is right.

I know when personal health insurance pays your medical in the case of a denied claim they get reimbursed if the IW wins but I have never heard of anyone being reimbursed for COBRA or any other health insurance premiums unless there is a wrongful termination involved. I am really interested in this. Don't know that it has ever come up before.

Cap, I have heard long ago, that the work comp Insurance has paid for peoples health Insurance Policies. Just maybe, that is what is being said.

I even heard them pay for health insurance in a settlement offer.

I guess it matters what is being demanded also.

Plus, if the Cobra was forced to be used for the injury, then I can also understand a the pay back. That would make alot of sense if being denied treatment.

I believe that if you win your claim, your insurance company will go after workers comp to be reimbursed what they have paid for your workers comp injury only.

Cobra is optional. It is you continuing your company paid policy once you are released, but self paid by choice. The insurance is used for ALL your medical, not just WC. Often it is a "family" policy. That is why I believe you won't be entitled to any refund on your premiums.

It is good to keep your insurance as long as you can afford it because if your cancel it, then later try and get a policy; the new insurance company can say you have a "pre-existing" condition and reduce coverage.

A work injury causes so many negatives in life. It seems like every time an injured worker turns around, they are getting screwed by something or someone else in the system. I don't trust anyone in the WC system no matter how nice they may be.

Hurt...I agree it would be wonderful. I do agree with Chris though. Mine and my husbands insurance CO. was reimbursed for what they paid out before our claims were picked up. Badboy is very knowledgable with these issues and if you really think about it I guess it could be part of a settlement. I am really curious about this as I have never heard anything like it and besides here do know a few people that were IW. Different states, different issues.
Best of luck. I still say if ther eis a wrongful termination involved that would be the key piece of the puzzle because then you have lost your insurance wrongfully and were forced to pay COBRA whereas like Chris said COBRA is optional.
