employed 7 years for same company. fighting me on my claim. how long will this take?
employed 7 years for same company. Started having back trouble and hurt my back several times and the long hour in a bouncy truck mad it worse. Boss punished me and refused to let me come back to work if i didnt keep fudging my log books even though i told him 20 plus hours a day was causing me to get hurt and i couldnt do it. I had gone to doc. and he worked me over and told me to take a couple of days off ( i paid for this appointment). long story short my boss refused to let me work the regulatory hours and refused to pay for and doctor bills so i had to file workerd comp. i filed in july and here it is 6 months later, my children will have a very limited christmas and i need my back fixed so i can provide for my family. ANY WORDS OF WISDOM?

Hi Cindy1959, What state are you from? Workers Comp rules vary from state to state.
If it were me, i would contact a lawyer immediately. Sher

Hi and Welcome to the Forum! I'm a Class A Driver Myself, so I Understand what You Mean about Your Log Book. Your State would be Very Helpful in Trying to Answer Your Questions, but have You Heard ANYTHING from w/c? Were You Approved or Denied? And You know a Simple Call to Your D.O.T. would Stop the Log Book Problem, if Your Employer wants to Play Hard Ball. It seems to Me like You need to Discuss this Situation with an Attorney that works in the w/c Arena. Length of Employment You will Come to Find doesn't Really Matter, everything that Happens with Your w/c Claim has More to do with How Interactive Your Employer wants to be to get You Well and the Monies You need to get by, with the Way they Answer w/c when Contacted about Your Injury. They will Either Agree of Deny if it's a Work Injury, at that Point You will know How Your Employer is going to be through this Process. It seems that Loyalty to an Employer doesn't mean Much to them these Days, and I feel that's a Shame. Best of Luck, and I Hope You get the Help You Need!!Wink

Thank you for the help! The employer has told w/c to denie the clame. The w/c attorney said she would try to get him to take the responsibility needed. But my aunt is a B&&ch and has even caused problems at my moms job and the mental stress got so bad she had to leave.I have met with the w/c attorney and given my deposition with my lawyer present (5 weeks ago) got a response that there will be a trial soon. I really hate to play too much hard ball because this is also my uncle. All i wanted was him to do the right thing and help me pay the medical bills to get the problem fixed that developed while in his employment. Can you tell me what to expect from the trail? When the boom broke this last time my mom was with me, does she need to go to court? I would appreciate any information you can share. Thanks

Sorry to hear your having trouble but one thing to remember with WC is nothing is quick. They can drag things out for a long time and yes you may go without pay or lower pay for a time. My employer cut my pay in April 07 and I just got a hearing last month to get it changed. Should get an answer any day now. But even if WC say they have to pay me they can appeal it and drag it out for along time to come. I know this info doesn't make you feel any better but it will just make things worse if you get in a big hurry. They will know they are getting to you and sometimes use that to make you settle things for less money or even worse make you settle without taking care of all the medical needs. And it is why so many have depression. Not only do you feel bad but the lack of money and the need to fight for every thing you get doesn't help. Hope this helps alittle but know your not alone in the problems, most have the same ones.

Play hard ball. If it's your uncle he should be treating family right and taking care of you. If not it's time for him to take a hike. Your attorney here in Oklahoma wouldn't have taken your case if she didn't think you had a good case. They don't get paid if you don't get paid. Most of them won't waste their time on bogus claims. Just try to be patient.

I do plan on doing what is right and fare in societies eyes. You know when its all said and done and we are on our death bed family is what matters. do you think 6 months is a long time for this issue to be pending?

6 months is nothing when it comes to WC, There are many injured workers that have waited years, I myself waited a year before my case was excepted. Be patient, fight for your rights, and have faith in your attorney..... Good Luck.
