SSDI/SSI STARTING SOON QUESTION
I am currently getting W/C. SS has already refigured my benefit amout reflecting my W/C weekly payments. They used the 10 yr 80% average rule to come up with a starting figure. My W/C only allows 2/3 of my past 52 weeks average. That SS weekly benefit amount was more than the W/C weekly figure. Do I need to expect that the W/C ins. co. will reduce or even discontinue my checks due to the fact that my SSDI amount will be a little less or equal to there benefit amount? Thanks in advance for any advise/comments on this.

Your WC. benifits have nothing to do with SSDI. Your SSDI benifits have something to do with your WC benifits. Your SSDI benifits will be reduced to the point to equal 80% of your pre-injury wages. Once your WC benifits end, the SSDI benifits will be raised to max. allowed for you. I hope that answeres your question.

It depends on which state you are collecting WC from whether the WC is reduced or SSDI is reduced. For example, in Florida, it is called a "reverse offset" state and the WC is reduced, not the SSDI. I believe the following states take the reverse offset:
California
Colorado
Florida
Louisiana
Minnesota
Montana
Nevada
New Jersey
New York
North Dakota
Ohio
Oregon
Washington
Wisconsin

Generally, the total of benefits payable plus your WC and/or any PDB (Public Disability Benefit) payments cannot be higher than:

80 percent of the amount SSA calls your Average Current Earnings (ACE); or

Your Total Family Benefit (TFB) amount (whether or not you have a family receiving benefits) payable in the first possible month of offset.
