At a loss

Thanks Still in Limbo. and others for the advice.

Monday morning I'm going to be on the phone pestering my Lawyer. If that dont work I will sit in his waiting room untill he asnwers some questions. If that fails I am going lawyer shopping.

I seen my boss Friday afternoon and she was asking when I'm comming back, I told her it was not that easy, and I was following the book on this. She wants me to call her on Monday and says I will need a letter saying I can come back. So I agree, my lawyer needs to step up and do his job now that he is needed.

Does anyone know of a good WC lawyer in WI.

For those of you that have been following my post.

I waited all morning for my lawyer to call, I ended up calling him. Told me not to return to work until he has the fce report and return to work slip. And I told him that I was being put at end of healing from local dc. And I had to go on telling him my surgeon figured 2 years before mmi. Now I have been trying to contact my surgeon and I must be red flagged or somthing cause they know it is wc case, and tells me I have to talk with thier wc nurse at the clinic. And she is not returning my calls. I know clinics can be very busy, but I am supossed to call my employer today.

Should I just call and say my lawyer says not until he has reports, " they know nothing about me having lawyer".

Or should I stall and not call.
God I hate this wc crap.

Hi My Friend,
I am in the same boat as you, but I don't have an employer so I can't say anything in reference to you about that. I would if you can, go directly to the Dr Office and speak directly to the person who handles the WC Case(S) and tell him/her what your ATT said to you. If they like it or not, at least you would feel better. Don't by no means go into detail about what your ATT has told you in regards to any settlement or the case in hand. Then I would go directly to the ATt and demand to speak with your ATT, remember he/she works for you and not the other way.
I have been in this mess since 2006 and I can tell you that, it sucks being on the this end if the food chain.

Bronco, I can't believe for the Life of Me why Your Attorney isn't Handling this for You?? You should not have to be doing all of this Leg Work, that's what Your Attorney or Their Assistant is to be doing. And I don't know how Your Attorney Handles things, but I'm not Allowed to Call ANYONE without My Attorney's Approval, and He wouldn't want Me to Anyway. Just my opinion, but I'm Really Starting to Doubt Your Attorney's Abilities, and how They are Handling Your Case. You May want to Write down all of Your Concerns, even the Little Ones, and set down with Your Attorney for a Nice Long Talk, and if they don't Satisfy You when Your done, Start Shopping for a New One. I just want to Give You and Example Using My Attorney: His Assistant was to Send Me a Check that I should have Received on Saturday. She Didn't do it Right, and for the Very First Time I called and Left a Message on My Attorney's Private Cell Phone. He was Hunting, and Called Me Sunday Evening, and Delivered it to Me Today, He went in Early to get it Handled, and Dropped it Off on His Way to another Appt. That's how Attorney's that Care Handle things, and I Fear You have One not Paying too Much Attention! I Hope and Wish the best for You, and Please Keep Us Updated!!Wink

Well just a update. I got a call from Marshfield yesterday, She went on telling me my surgeon handed the ball over to my local dr. And says they have been updated all the way. She says as fdar as the ratings go my local dr could do it if he wants. I said no, He dont want to do it, he never had case like mine, and is leaving it up to a surgeon. she said ok and will see me in FEB, and discuss it after my checkup.

As far as work goes I go back DEC 23rd, I got a call from boss today and said every thing was being sent from dr to the Milwaukee head office. Thats where all the confusion was taking place, WC was sending it there and no one was sending info here. And I have Dr's records being sent to me and my lawyer.

Now All along I have not needed my lawyer, besides calling him and asking for advice. I signed up with him last March but it was to handle other issues as well as WC, I had a reaction to heparin while in hospitol, ended up having emergency surgery, bleeding internally.

If I droped him as my lawyer would I have to pay anything off of any future settlement's.

Yes your attorney will split the portion that they get between him and any other attorney that you will have. The only difference if you are in a legal group and he leaves their firm - then they may not have to split the attorney settlement portion. This is normally done by the courts as to what percentage each attorney will get and also varies from state to state.

I hope you have copies of your restrictions if you are not at MMI and not able to return to full work. Your company may ask you to do things outside your restictions and at least with a copy of your restrictions you can show them and say NO WAY your breaking your restrictions and getting hurt more.

Take it from someone that wasn't taken off work and ended up getting further damaged because of what WC doctors did.

Thanks Pooh.

It's just if I keep doing the leg work I dont think he should get his full cut. He didnt have to fight to get my weekly checks my wife did while I was in a coma. The only thing he has done for me is I had some papers from my private ic wanting reimburstment for any medical expences that wc dont pay.

And yes I have kept all copies from seeing DRS but have not recieved the fce report yet.

you can file an objection to his share of the fee at settlement time but generally it's between the attys and the comp court.
you can also file a complaint with your state bar.
