|
I was injured at work(carpal tunnel). I filed a claim and have been accepted. They sent me to their company doctors and I've stuck with them. They tried physical therapy to no avail. I was sent to a nerve analyst and he came up with the need to have surgery. I am VERY unhappy at my job and want to give my two weeks notice but was told that if I quit then my workman's comp. case would get messed up. Can anyone tell me if this is true or not?

Did they doctor take you out of work? What state are you in?
carpal tunnel recurrence/ neuropathy / RSD. 1/29/07 injury date. Permanent. PIR settlement 8/4/08 10% |

your WC case is ok till you are done with WC... quit your job might have some problems with getting a check each month....a new employer may not wanna take you on knowing you are going out for surgery...if you can handle it at least wait to quit till you are done with your WC case
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

The State You are in would Help, w/c is Governed by each Individual State, so Rules are Different for Each. I Believe Jayne is Right, You would Probably Lose Your Weekly TTD or PTD Check, but I believe they would still have to Repair Your Injury. But if You are Quitting until the Surgery is Over and You are Better, then You would be Voluntarily Taking Yourself out of the Labor Market, and that could Really Cause Problems. If You are still Working, and they are making it Hard for You because You Filed a Claim, You May want to Speak with an Attorney that Deals with w/c Cases, You have Rights. Also if You are Working with Dr.'s Restrictions, and they are trying to get You to do More than Your Dr.Allows, You Legally don't have to do that Also. So as You can See, it's Pretty Complicated and You should Brush Up on Your States Laws to Help You See where You Stand. On the Main Forum Page there is a Tab "Info. by State", that May get You Started on Finding where to look for what Rights You Have. My Best, and Please Keep Us Updated!!
