need advice
im in ny state my case is presently marked no further action by workers
comp board with continuing award.attorney says it would be in my best interests to be classified as permanently disabled.letter says such a finding would give me added protection into the future. i am going thru vesid recently took a test on what im capable of didn't get call yet on results from counselor. i have 4 bulging discs no nerve damage any advice on what to do it's an old injury recurrence and gettin salary from 19991 thnks all ... |

Your attorney is right. As long as you are not Permanently disabled you are at the mercy of the IC. Get an opinion from your physician and have it submitted to the comp board. Expect the IC to set up a IME appt with thier Dr. Dont get nervous when you see thier Drs report. They are paid by the IC so they will most likely play in the favor of the IC. Answer all the Drs questions with yes or no. Do not elaborate. Be cooperative during the exam. Take someone with you to take notes on everything the Dr asks and does during the exam. If the IC Dr hurts or injures you in any way during the exam , call for an ambulance .More than likely but not always the WC judge will rule somewhere in the middle of what your Dr and thier Dr reported. Hi,
I've never heard of the IC sending anyone to a Chiro either. In fact they refused to send me to a massage therapist even after my treating & IC Dr ordered it. Have you applied for SSD yet? Lilly Injured worker, & tired of it all! I'm too old for games!! A careless word may kindle strife, a cruel word may wreck a life, a timely word may level stress, and a loving word may heal and bless! |

not yet as i stated lawyer wants me to get statement from my doctor that my disability is permanent and submit it to him. then set up a hearing,,
also have one more question. im still paying union dues and have bin out of work 10 months.am attending vesid now and recieving workers comp. if i do get fired what happens then with unemployment and comp? thanks |

they not trustworthy unfortunately.. what do you think if they fire me i know i can't collect unemployment when im on comp.what do you think i know unemployment is gonna pay more since im gettin 1991 wage.
