In California...SSDI, SS ?????? Sorry Confused
I looked on the state website, but I am still soooo confused. Just a few questions.... I am getting another surgery hopefully next month. When I get taken off work before and after surgery and I am collecting TD can I also get ssdi or ss. And what is the differance ? And last question, I have been off and on at work, mostly off since 2003 when I got injured, will they back pay me. ( I know stupid question, but..... wishful thinking. Hope all is well with everyone. Sorry I have not been here. work work work. Oh yea I am in California. Thanks

sdi is for non-work related disability.
yes you can apply for social security while recieving workers comp TD. they have an offset so the combined payments can't go over 80% of your wages The difference is that social security is federal and is based on your contributions and doesn't include medical. (have to apply separately for medicare) while workers comp is state and paid by employer contributions and includes treatment. If it's determined that prior time off was medically authorized and due to the work injury then they'll pay disability for that period. |

Hi Lip, I hope you are well today! SSDI has a 6 month waiting period, and you can apply if you are going to be off of work for a Year or more, Even if you Dr. feels you may be off that long, you can apply after the six month anniversary of your injury. I hope this helps, and you can collect both SSDI and w/c payments, but they will not exceed 80% of your average wage! Good Luck!!

hello lip. I had made a post titled social security disability. With all the info I received, I applied for social security disability on line. Two days latter I received a letter from them for an interview. That took about a hour and a half.
In my case I was off work for eight months, returned to work on light duty status for six months, and back off work for six months. ( That brings me up to date.) The interviewer asked me why I waited so long to apply? He also told me what my benifits would be and that I would only be receiving $700.00 from them while I was receiving temp. income benifits from comp. I wish I new that sooner. I asked what the time frame was to get a response from them. He told me he was supposed to say 4 to 6 months, but they have been responding in 3 months lattely and most of that time is spent on collecting medical records. At that point I handed him my medical records and he said I may hear something as soon as 2 months. I hope this helps. 8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins.
