well i finally saw my own dr today about my back injury im still not sure what is wrong but my dr at the andrews institute in florida is at least trying to find out what is causing my pain. w/c/denied the whole claim when they found out i had a prior chiro history no major back injurys though ,my parents always took us to chiro first then md anyway so i have alot of chiro history and i didnt check the backache box on application when i was hired,because although i had had backaches i never had a back injury which is what i thought they ment any way my lawyer sayes that i have no case wants me to settle for 2000.oo tomorrow. my question is can martin/carpenter really ruin my case, once i sign the papers i give up my right to sue ever again My dr today is putting me on diability. i absolutly did not have this pain before januay,lawyer says doesnt matter that im disabled, if there is a chance that he might wrong i dont want to settle for 2grand cause i cant work anymore. can anyone help me

I fail to see the rationial behind the chiro issue. Did you see a chiro recently before the claim????? If not, I fail to see the issue.

Hypothetically, Someone sees a chiro a year before they were injured at work. The work injury was to the spine. Can an IC denie a claim because the individual saw a chiro a year before??????

I think NOT. For the individual was working for a year after seeing the chiro. Hence, the reason for seeing the chiro was healed.

Just my thoughts.

Interesting. I was told by my own surgeon that I shouldn't attempt to go to a chiro because w/c don't see them as "qualified" to give a proper diagnosis or treatment. If that is the case, then why should they disqualify you if they don't believe that a chiro knows what they are doing?

And I agree, it doesn't seem relevent that you saw a chiro in the first place since so many people see them as a first stop for any type of pain....unless the paperwork from the chiro shows a specific proplem that is exactly what you are suffering from now.....it shouldn't matter. I would definately get some advice on this.

When my doctors asked if I ever had any pain similar to what I have now....or any back pain...I put that I did when I was pregnant, but not exactly the same. Didn't make any difference to my claim.

And I have degenerative spinal as pre-exisiting...........BUT the accident I had exasperated the issue.

Sounds like they have an issue with the fact he didn't tell them he had any back problems before he was hired. But that is just my quess. I don't think it would make allot of differance but then I'm no lawyer. As they have said if it was in the past before the injury I'm not sure it would be a big problem. Hope some one can give you a better answer

Hi,
Even if you did have prior back problems , I fail to see what their problem is ( and denied) , as you were ok and working all along, until some new injury exasperated your old problems. I'd call the lawyer and ask him to explain it to me in detail. Not answering yes to the orig form question is no difference than being asked if you've ever visited a doctor for an illness.....who the heck hasn't????

Most Times, when We get Injured, and We are not Sure of the Diagnosis the Dr. gives, We get a Second Opinion. I think in Your Situation, My Opinion Only, You need a Second Opinion on what Your Attorney is Telling You!! I have never Seen an Attorney seem to Fold so Quick, I surely don't know All of the Info.in Your Case, but going to a Chiro. as a Child or Young Adult should have no Bearing on Your Case if You have the Right Attorney Fighting for You. And as far as not Checking the Back Box is a Technicality that I'm Sure any Competent Attorney could Handle!! Again My Opinion Only before You Sign Anything, have a Consultation or Two with Other Attorneys before You Sign!! A Weak Attorney should not be the Reason that You don't get the Care and Monetary Compensation You May Deserve!!Wink

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!
