Preliminary Hearing Scheduled
I received the letter from my attorney today and he has rescheduled my hearing.

The letter I received reads:

Please note that we have scheduled a preliminary hearing to address the following issues:

1. Medical treatment to back
2. Medical treatment to right upper extremity
3. Additional medical treatment to right knee.

The insurance company asked the judge for a continuance last month when they found I had been in an auto accident last December. They questioned if the back and carpal tunnel were related to the auto accident.

I have medical records dated 1 year previous to the auto accident
that show problems with the the back and medical treatment I received and paid by my health insurance.

Yes it is.

2. My right knee, has been giving me problems started previous to the replacement of the left knee. Been giving out, a couple doctors wrote in reports it may need replaced. I had meniscus, pica, and chondromalacia repair of the right knee 2/07.

I am requesting my bone joint doctor to eval the knee in hopes I won't need surgery.

Thank you Still In Limbo.

This hearing comes a day after my daughter turns 18 and a day before my niece,
(I have coustody of) turns 16.

Maybe this means something.

My Best to You Bummer! You have had to Endure so Many Delays not Only Legally, but also in Receiving Care for Your Injuries, You Deserve a Good Hearing!! You have a Top Notch Attorney, and the Medical Evidence to Win, that is Probably Why they chose to Continue, because they know when it's All Said and Done, they will Lose, and they want to Drag that Out as Long as Possible. I Believe You Read My Other Post on My Good Hearing, and that One was Continued also! But the Judge this Time is Different, (We Only have 2 w/c Judges in My County, so only 1 or the Other can Hear My Case), and this Judge is More for the Worker than the One I Won with in April! When the Judge Granted the Continuance, they Usually give up to 60 Days, and the Defense only got 2 Weeks! In My Case as In Yours, Cases where the Medical Evidence Supports the Claims We are Making, the Defense will Procrastinate as Long as they can get Away with, Hoping they can catch Us doing Something Wrong with Surveillance, or We just get Fed Up and Quit. And You would be Surprised how many People get so Frustrated and Alienated and do give Up, it's a Shame, but Many do. But the Day will come, as Mine did Friday, when they Run out of Excuses and Delays, and have to Face the Music!! Be Patient, Your Day will Come Bummer, You have Worked Hard, and Deserve it!!!Smile

Bummer, I had my right knee meniscus repaired after my (Left knee Replacement). The right knee will give out, and I have to be careful. But, I found, wearing a good (Very Good) Knee Brace Support does help the problem of it giving out. I hope you will try one, when walking about.

Thank you for your post.

Still In Limbo
My attorney feels positive with the outcome of my case. When an attorney feels they are going to win they have a certian body language. When I visited with my attorney in his office and gave him the medical records I have he did the motion of kicking back in his chair and placing in hands behind is neck and smiled. His body language showed he felt good about things.

My only worry is the auto accident with the neck injury and what the insurance company will try and make out of it.

Bad Boy
I had meniscus repair 18 months previous to the replacement, my knee dosen't feel like it did when I had the meniscus tear and pica repair. I do have lots of nerve pain down the back of this leg and wonder it that may be part of my problem.

Are you suggesting a soft brace, if so I should be able to get this a Wal Mart.
