Rejection from w/c
Hello everyone,
I have a question about my niece. She has been out of work since August do to a back injury. She also has Lupus. W/C rejected her claim. She has a Lawyer. She wants to stay out of work for at least a year in order to try for SSD. Her health history is so complex that I can't see SSD turning her down. What should she do? I have another question about my case. What should I do about W/C refusing to treat me for my lumbar problem. It was found that I have pars interarticularis defect with compression deformity of both exiting L5 nerve roots within the neural foramen. Due to the pain I have not been able to return to work. I spoke with my attorney's assistant about workers comp refusing to treat my Lumbar Radiculopathy. She stated that it will be part of my evaluation when I see the AME in Feb. What am I suppose to do in the mean time. I thought the purpose of having an Attorney would be to handle these type of issues. |

Unfortunately resolving issues thru the legal system is very time consuming and there are few short cuts.
You should file for SDI benefits if you haven't already. If a decision on your claim is being delayed they still have to provide treatment until they've issued a denial. If the comp carrier has issued a denial you can get care thru your regular health provider (they can get reimbursed if the court issue a decision in your favor). I would think your niece should apply for SSD and appeal any denials but I'm not sure that's what you're asking). |
