Need Help
My husband was recently injured on his job and required emergency surgery. Not even a week after surgery we received a call from a workman's comp rep who stated they would not be paying any medical bills. They stated my husband injury resulted by doing an activity not included in his job description. This is bull. I have decided to seek the advice of a lawyer. Will I be expected to pay lawyer fees or will they be paid from a percentage of a settlement if this does occur? We are living on only one income now. Just making ends meet is difficult let alone trying to find a way to pay for the cost of a lawyer. Any advice would be appreciated.

Each state has their own rules. If yours was known, more info. could be provided. With that being said, most if not all states, the attorney only get a percentage of whatever benifits he gets his or her client.

Thanks. The injury occurred in the state of Virginia. His boss spoke with a workmen's comp rep and stated that he was indeed injured doing his job although it may not have been stated word for word in his job description. How many of us actually see our job descriptions written out word for word? This is our first experience with workman's comp. We were hoping the system would work but it seems as though it will be a fight. Workman's comp scrutinizes everything and we have no advocate on their end helping us. A lawyer is probably the best option.

the person that turned in your claim didnt do there job rite.were i worked they paid the nurse extra to do what ever she could to have wc not have to pay,what a suprise and im sure there is alot of that that goes on that we dont know about.dont give up you should not be paying for anything................good luck and keep fighting for ur rights.

Losing It, If a Supervisor or Foreman Asked Your Husband to do what He was doing When Injured, He should be Covered. I was not doing what I was Hired for when Injured, but My Dispatcher Sent Me on the Job, therefore My Company was Held Liable. Please Check into this, and Welcome to the Boards!!Smile

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!
