father passed away on full comp have ????
Hi everyone new guy here with some questions.My father recently passed away and he was on full comp from a accident in 1976 which left him a parapelegic. Now i am dealing with comp because he was in hospital for 5 months before he passed with recurrent pnemonia doctors said it was due to previous accident in 1976. So iam forwarding all the medical bills to them with no replys. now i just got a letter in the mail that i have to go to a hearing with the reason listed as "lost time to date of claimants death". can someone please tell me what this is and what to expect? I have no idea what this will envolve. should i bring lawyer with me? thanks for any and all help. by the way i am in NY.

I dont think you can go wrong by having a lawyer with you. If it was me I would at least talk to a lawyer ahead of time to get some advice.

Most states have specialists or ombudsmen to help others negotiate the system and answer questions. What's yours?
I'm just guessing but I suspect they want to make sure all disability benefits have been paid and there are no amounts outstanding or overpaid. That would also certainly be a good time to bring up any outstanding medical issues. Most state work comp systems also have provisions for burial expenses so you should ask about that as well. Visit your state's work comp website to see what contact information is available and what related benefits there might be. |

Jer- Sorry for your loss. Contact a wc lawyer, if you father had one he would be the one to talk with and have him go to court with you. If your father didn't have a lawyer. I would advise you to get one. Call and get final bill from all medcial providers and take these to lawyer and copy with you to court. That way you can make sure they all are paid. Take the final expense bill to lawyer and ask to have it paid as well as all legal fees.
