Tweety this is my story......I hope it helps. Injuries: cervical, left shoulder, lumbar, right knee and right ankle. When I reported the injury, the day I was injured I included all body parts. Five days later when a WC representative called she said her supervisor (the adjuster) wanted to know just how I injured 5 body parts. I explained it to her. It was almost like a domino affect. At that point most of the swelling in my ankle went down and I told her so. Saw one of my employers Dr. a couple of days later. He picked up all 5 body parts as being directly related to the job I was doing. Went to an IME 2 months later. He picked up the lower body injuries but not the upper. Claims to have read all MRI's but in fact I had only had my neck MRI done at that point. OK so how could he have read the other 4 MRI's if they weren't even done yet? He picked up my knee because of a prior injury. This injury makes the knee buckle and a rollover of the ankle. Ankle was badly swollen again when I saw him. At this point I have a PM Dr. and a Spine Specialist who have given depos pickingup all 5 body parts. The IME states in his depo that only the lumbar, knee and ankle are job related BUT he also lies in his depo about what I was doing when I was injured. At his point all is in the Judge's hands. He will make the call. He will decide if all body parts are work related. I would think that a 2 inch rotator cuff tear came from overhead lifting. This is where the IME lied. He claims I was puching a cart. WRONG! My attorney has handed in paperwork that I filled out in the IME's office staing exactly what I was doing and went up the IME's butt at his depo. Asked him IF he reads his own paperwork So you see Tweety the norm is for anyone that works for the IC to lie and twist and turn statements around to their advantage. it confuses the &^%* out of most of us. Always remember they get paid not to pay you. My lumbar, knee and ankle are pre-existing job related injuries that were accepted the first time they were injured. Alot of crap HUH?CAP God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |

Question regarding games W/C plays. is it totally up to them when they controvert additional injuries-example after hurting the back, then had to have a hip replacment(they controverted), then had exacerbation of neck problem(they controverted). They state that it was not from original injury, but the were exacerbated by original injury-so do they have the last and only say on this?
Also did have an IME from neurologist hired by WC-he did not even refer to the 2 discograms I had done-as if they did not exist- they were not even mentioned- and he also questioned the fact that I had eve even herniated a disc! Stated that he did not have the original films and tried to make it appear that the herniation didn't even eixst. I could not believe it, but after thinking about it-this is how they make their money right? |

Now you see why we feel like we are fighting to the end of it all. Things are done hoping you give up. Maybe not all cases. But many that we may read here or on other WC Boards. IME; Gosh, their strange, but also in your case protected themself, by not stating anything about the Films and such. That way you can't sue them for Mal-Practice, all they have to say, was the didn't see them, nor were they present at the time you were there. Sure it all may be a lie by the IME, but if the IME caused you no harm by means of injury, you have little to fight them with. (That is why, I say, when anyone has an IME performed, to also get their Treating Doctor or Surgeon, to also perform a Medical Evaluation. Then you protect yourself of proper Medical Opinions. For that is all an IME is, it's an Opinion only, nothing more nothing less) Reply's are intended solely for informational purposes. Another wc game...
My attorney scheduled a court hearing for payment of mileage for a trip I made to wc dr 600 miles away. Instead of the IC paying the mileage and mailing the check, the morning court is scheduled and 30 minutes previous to the start of court. A check is delivered by UPS to my attorney's office. Had this happen in April, I have court scheduled later this month for mileage payment again and expect the same thing to happen again. |
