you/we need to correct bad information whether someone makes it personal or not -- and I certainly don't. Good accurate information is one of the few ways workers can level the playing field. That takes precedence over the chance of a few hurt feelings. feel free to correct away, I not that thin-skinned.

I was told by my HR department that I would lose my medical coverage once I went on work comp/state disability. I have been out of work since August 1999 and still haven't received a letter of termination...BUT...I am pretty sure I was terminated with out notice by now.

Babe........to my understanding it is up to each individual employer whether or not they pay your benefits while out on WC. Mine does as long as the case was not denied. Since mine was denied the employer paid it until I used all of my sick and personal days, FMLA and am now on unpaid leave. Once on unpaid leave they offered to keep my benefits in tact at my expense. That is up to the employer/whatever their rules are. They must treat all IW equally. As far as stae/disability goes I'm not sure what you mean since Ihad no seperate disability other than my pension. I would have to retire to collect from that and won't until my case is settled. Hope I made some sense. CAP God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |

Very good post Cap!! I think that explains it about the best that I've seen! I don't want to say you're number one Cap., but you sure as Hell are ahead of the one in First Place!!
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |

I am from Georgia so I don't know if this will help you or not, when I was taken out of work by my WC doctor-I took the form to my employer and gave them a copy-they acted as if I was out on FMLA even though I had the form from my WC doctor. When they FMLA time was up, I was fired because I did not return to work, I too was sent the COBRA information etc, they did not give a reason for firing me. WC did not pay me anything for 8 months, but did continue my benefits.

I was terminated too while on WC. I was terminated about 4 years after my injury in 2002 & they gave no reason. My ins. cancled too. I'm now on SSDI & WC. Medicare pays for my regular meds & WC pays for my pain meds. Take care & good luck.
