Welcome Many!! We are going to Need a Whole Lot More Info., including the State You are in to even begin to try and Voice an Opinion. Please take some Time and explain Your Injury, How Long You've been Off of Work, and what Operations You Need. That should be enough along with Your State to get some Replies to Your Thread. Best of Luck, and Have a Great Evening!!Wink

they can't "make" you; but the carrier is not required to pay disability if there is work available and you are released to do it by the doctor.

RE: Going back to work before the surgery!
Hey Still...To answer your questions... I was injured three months ago in MA. My doctors (I have three) are stating that I should not return to work, due to the work I do. But, the Independent doctor working for workers comp without even looking at any of my x-rays, MRIs or reports and without touching me during the exam states that I am fine to return to "full duty" work. The injures I aquired were herniated discs in my neck (not sure yet on course of action), elbow and wrist surgery (upcoming).

I agree, Lawyer-up!

You certainly do not want to injure yourself any more than presently!
Take care, LillySmile

ahhhhhhhhh the WC doc....get a lawyer if your primary doc says no work then its no work ...course they may not pay you till you go to court...this is where a good lawyer comes in.....

;)Workmans comp is not a road you want to travel alone. You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life, you have come out ahead of the game.....Smile

Big Grin RE: Going back to work before the surgery!
Thank You to everyone who answered my post...

I will try going the lawyer route. I didn't want to go there and be considered as someone who is trying to take advantage but... I guess I have no choice.

Thanks again

RE: Going back to work before the surgery!
Welcome many.....Those who have an attorney are not taking advantage but are trying to protect themselves from the unfair issues that the IC is allowed to do to an IW> As you can see you need two surgeries but are being sent to work against your Dr.s orders before you even have them. An attorney can protect you. I have been sent back to work once by the IC's Dr. and since it was against what my Dr. said and mine has proven to be more credible the Judge refused their petition. Best of luck.
