I'm glad you asked the question because I was wondering the same thing. I am also from Illinois and the arbritrator signed off on my settlement on August 22nd. My contract says the IC agrees to pay me PROMPTLY after receiving a copy of the approved contract. Now what does the word Promptly mean??????????

Maw, Mine said the same thing, it still took 8 weeks. I wonder if it is not a form letter we all receive at settlement......

As I said in another post, I was sent a letter of my hearing decision from the labor board for the ic to pay me my 10% impairment award. I waited almost 3 weeks and decided to call the adjuster for the IC to see why it had not come to me yet. The adjuster said he was sorry as he overlooked it and would send it out that day. The next day it was stuck in my door from Fedex.
You can report it to the labor board if they still have not paid you. They will hold onto the money as long as possible to collect interest and there is a penalty if they are late paying it. Do you have a lawyer? If you do, maybe he is sitting on your part of the money. You should also call your lawyer to see why you had not been paid yet. carpal tunnel recurrence/ neuropathy / RSD. 1/29/07 injury date. Permanent. PIR settlement 8/4/08 10% |

Sparkey, Here in Illinois, It is the IC that holds up the check, They have 8 weeks to comply, and most hold onto the check untill the last day. My attorney said it would not matter if he called the IC or there attorney, that is how things work in Illinois. There is always the chance that the check will arrive sooner, within that 8 week period. It's anyones guess Only the WC IC know's for sure... Once my attorney received my check , it only took him a day to process and do the paper work and issue me a check, 2 in fact. So hang in there the check will be coming.

The IC holds the check here in NH also. The adjuster of the IC is the one that I called to get the check mailed to me. That is when he said " oppps, I saw it last week and forgot to send it out. I will send it out today." That is when the check arrived in my door the next morning. I said I thought I would call him before I decided to contact the labor board to see why it has not been paid. It was to be mailed promptly after the labor board decision. There is a penalty if it is not paid in a certain amount of time.
I know every state has different rules. My lawyer called me today and said he received the check from the IC today. It took 2 weeks for mine.
