Time limit?
I was injured on the job. I had 2 knee operations. I’m 66 years old. I retired due to my knee a couple of years back.  I’ve been to court and received a settlement, also the judge and my attorney informed me that I have 2 years from the day I receive my final check that I could reopen my case. My 2 years was August 30,2006. Around March 2006 I told my attorney I’m having problems and I want to reopen my case. He sent a notice to the insurance company and they sent me to their doctor. July 2006 I also went to my lawyer’s doctor.  It’s like a year now and nothing has happened since. I asked my lawyer is there any time limit on from when we reopened the case. My lawyer doesn’t respond to me.
Let me ask here, from when I reopened my case is there a time limit?

What state are you in?
Search the states workers compensation laws to see BUT if you were treated within the two years then you should be able to continue as you seem to have met the criteria.
Bug the heck out of your attorney, thats why he/her are there, to serve you!

I'm in New Jersey. I can't find the information on my states comp laws. When I ask questions at comp board/court clerk, they tell me see my lawyer. My name troublemaker was given to me, i've been called it many times. Over the years i've threatened my lawyer (not bodily harm). I've also read him his code of ethics.

I asked my lawyer to reopen my claim because of the pain I suffer. My knee gives out at times. I've lost my balance, i've fallen. When driving my car at times I have to pull off to the side get out and strech my leg. No meat between the bones, arthritis from the first surgery, bone splinters. I walk with a limp. I use a cane unless I'm at a store with shopping carts. I figure one day I would need a replacement. So if my claim is reopened and no time limit I would be covered. My lawyer's doctor had charged me $300. for his visit and he says I have 95% leg loss, while insurance doctor says 5% leg loss. I pay for my pain medication, Avinza and Oxycodone both narcotics.

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile

Did the WC insurance doctor recommend any treatment? Are you working now or unable to work because of the injury?
