Thanks 1171......Here's my dilemna. Supervisor testified in his Depo that HE denied the claim because he was mad at me. Attorney tells me the carrier denied it because they didn't have an out-of-work note from a panel Dr. Employer and carrier both had the notes.  Sois this classic of them doing what they want? I don't want to invade anyone else's post so if you don't mind answering me elsewhere, I think all will go smoother. Thanks for your knowledge and sharing it.

The carrier cuts your comp checks so it's their denial that counts.
If you can prove they falsified the denial you may have grounds for a fraud report depending on how your state's fraud provisions are worded. contact your local district attorney. maybe they'll open a case against them.
Your state's department of insurance may also have a complaint unit that will investigate carrier practices.
