I have to fully admit, that Depression will result in lack of healing. I have no idea, how any doctor can sit truth on the fact, a person injured on the job, has to live in pain, deal with lost of working, and on and on, can say depression then is not work related. I would think it's more in the phrase these IME doctor's are using for saying depression.
My opinion is. 3 Doctor's can say depression isn't work related. Awww, we didn't see what their writing and saying is all. Take a close look at what the 3 IME's are saying... Okay, have we all re-read that statement now a few times??? If you say yes, what is missing??? ![]() There isn't anything missing as to say the IME is wrong... You all think I'm nuts now right??? ![]() Well, I'm not, the IME's are using their statement to say this posters depression isn't work related, come on, it's a true statement, have you seen the loop hole yet??? Ok, here, posters depression isn't work related, because it's being said it was not listed as their injury. See the loop hole the IME's are using??? The depression though is related only to the injury, as a sub-result. being said, it's not only an added part of the injury, but also a major part of living in pain from an injury. As you can see, I myself can sit here all day and say depression is not related to ones work injury, only because it was not report at time of injury. These doctor's are learning to use (catch Phrases) to benefit IC's from paying for treatment. I have also read there are books, and some classes for IME's to use that teach them all these little (Catch phrases) to use in reports. A good Attorney, should have the knowledge on how to combat these issues during a Depo. When I was sent to God knows how many IME's, my Attorney always said it may cost $4,000.00 for a Depo. I told him I refuse to pay for any Depo. Those IME's are the IC's chosen Doctor's, so in result of such, then the IC's pay the Depo cost. They did, and each time my Attorney busted them on (Catch Phrases), meaning the phrase had no bearing on my condition, and they were asked, if the depression isn't work related as to your report doctor, then how do you as a medical professional explain this persons depression they have now, when they have never had depression in their past. Awwwww, the truth always comes out. These doctor's know they are caught, and have to explain the issue of current depression then, but the attorney will dig on the issues of pain and such to prove the point, and get the documents change to benefit the injured work. I do appreaciate all inputs. I just want to add, IME doctor stated, I am depressed, because of "fear of pain". He gave some kind of fancy name to this condition, some type of phobia. On the other hand than why did he recommend multi specialty pain clinic?
I had an other IME a year ago for social security and their doctor related my depression to my injuries and to pain(ssdi still turned me down). So did several other doctors who seen me in the past few years. I think I just let the attorney decide what's best for me at this point. Kat |

Very true, phobia, now who would not have some kind of phobia, when they have not one clue what this pain will bring to you in the future. Heck yeah, I have phobia too. I, scared I just might get re-injured. Who the heck isn't.

A phobia is an intense, unrealistic fear, which can interfere with the ability to socialize, work, or go about everyday life, that is brought on by an object, event or situation. Bad Boy, you are so funny about this phobia thing. I think the IME doc copied out this "fear of pain" from my first FCE report. The therapist at that time kept mentioning this "fear of pain" in her report, although she added, when I pushed myself too hard, she could observe I was in severe pain because I kept grinding my teeth and grimacing.
My personal opinion... all pshyciatrist should be in the nuthouse themselfs. Kat |

Dear Doctor, Dear Judge, I too have phobia of pain. I sit all day and think if this pain gets any stronger then what it is now, and you keep telling me about my phobia of pain, I just might lose my mind and rip your head off. That should give them a instant phobia.

Well if I didn't suffer a work related injury and there is nothing wrong with my cervical and lumbar spine what am I totally healed from. My attorney catches them all the time just as you describe. I also understand where Kat is. IME and her own Dr. are saying she is depressed but that it is not a work related "injury". Could/would she win one day. Maybe. I personally opted to leave this out of my claim. Dr.s can all get caught at their own game. IF the system weren't corrupt and IW were not treated as they are I believe alot would have more staying power to get the help they really need and I also beleive alot more would return to their jobs if allowed to. JMO ![]() CAP God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |

Cap, and as you may know, I do remember why you and your Attorney left it out. I do think we are talking PTSD if I'm correct. If I am correct, then you see why I can relate alot with people....
![]() Remember IME's have books of known Catch phrases they can use. Only a good Attorney can fight those phrases. But, a good injured worker with the knowledge of the phrases being used, can also ARM their Attorney and prepair the Attorney for the battle Depo... I was reading one a web site today, on all the books IME's can purchase to better write their reports for the IC. And in the books they include the phrases they could use. BB...You are dead on the money.
PTSD it is. My attorney has found more BS in IME reports it's almost laughable at times. I think it's a disgrace that any Dr., actually studies this. How to twist and turn the truth to make an IW look like an ass and get kicked to the side of the curb with nothing. Debating injuries doesn't bother me BUT the fact that some, not all, IME lie and get paid really pisses me off.CAP

As Most of You already know, I Beat the Employer and the i/c in My First Round of Fights, which took 2 Years, and I am Sure to Beat them on the Current Appeal that is in the Judges Hands. So they are Sending Me for another IME In Sept., and not to the Original IME Dr., because He was Found not Credible. Now the Judge has said in Their Ruling that I can't even Work 4 Hours per Day, 5 Days per Week, so We are Hoping that this IME Dr. goes through the Roof with Inconsistencies, so We can Woop Him Good if We Litigate Again!! The Better and More Healed He Says I am the Better, because My Medical Evidence and Current PM Dr. have Proven already without a Shadow of a Doubt of My Injuries and their Severity. So I am actually Looking Forward to this Next Round, it's Now THEIR Burden of Proof, and not Mine!! This should Be A Ton of Fun!!
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |
