my attorney and the ic finally came up with a number i can live with. i talked to him this morning and he gave me a number that i was very happy with. he also brought up an issue that i thought was dead. about 2001 i was living in louisiana and i was working at a fast food spot and i fell. i went to the doctor and went to pt maybe 2wce. my lawyer said that the ic found out i got hurt before and by me telling everybody that i hadn't been hurt in the past thats a possible fraud case but he said we can avoid that if i settle. of course i act like i didn't know what he was talking about and he said he didn't know the facts. my first concern is if the ic has me dead to right on the past injury and if its a possible fraud why would they settle. so that must mean my past injury doesn't matter. my main concern is this morning i agreed to the settlement offer. whats the procedure and how long does it usually take before i get a check.

depends here in okla the judge has to approve it...it took about 3 weeks to get that ct date they brought the checks to the court hearing then the checks had to sit in my lawyers bank for 10 days to make sure they cleared.....then to keep from having to keep my lawyers check in my bank for 10 days to see if it cleared I went to his bank and got a cashiers check and took it to mine....

thanks jayne. i have a court date sept. 5th if we have agreed to settlement will that court date still take place. so overall you saying it took about a month before you got settlement. also whats your opinion about the first part of my thread.

no jayne i was talking about the past injury. if the job found out i had a injury and they still want to settle my case then i'm assuming the past injury don't matter.

Hi...I am not wishing any bad on you BUT I know someone who went through this. Difference was one injury was an auto accident so many years before the WC injury and somwhat different. This person really forgot. He had healed completely and has a statemnt from the treating Dr saying so before he returned to work. He settled his claim. 2 years later the Attorney General's office showes up in his driveway. They ended up charging him with more felonies than I can count. He ended up pleading to 4 of the lesser ones or risked spending 25 years in jail. He served 3 months in jail and 2 months on home monitoring. He has 3 years parole ahead of him. This has destroyed his life and threatened to destroy his family's. This guy never had a parking ticket. I read all ofhis paperwork and there is no BS in it. His attorney knew about this before he settled. Please be careful. Insurance fraud, perjury, theft by deception, etc can come back to haunt you years later.

that's what i was wondering. because i had forgot all about that. i was young and i fell at work and i got one of those "don't get paid unless you do lawyers" and she sold me out. i got hurt in july and i went to physical therapy maybe twice and that was it until she went to a hearing and got me $1500 and took 3 and gave me 1200. my lawyer said all that could be avoided if i took the settlement. which is crazy because if they found out you would think they would say we aint settling nothing we gonna take this to the judge and show that you lied. why would they even entertain a settlement if they have this. believe it or not the settlement they offered is more than the original 50,000 i had mentioned before. can someone please explain that to me. thats why i was thinking the past injury can't possibly carry that much weight.

the old injury was really nothing. it was more of a quick fix. i didn't do anything no mris. no nothing. 2-3 physical therapy visits and calling my lawyer 50 times a day.lol i didn't collect no worker comp checks. the only thing i got was my last paycheck and the 1200 check. thats why i totally forgot about that. it was either 1999-2000. so if my lawyer said they want to settle for 57,000 thats got to be a hell of alot cheaper than them making a big deal out of my past injury. i know you said that it could come back and haunt me later, but could the judge be like "you lied about your past injury and your claim is denied" or it wouldn't make a difference far as my case. i'm guessing the ic would have to make something out of it.
