Problems with atty......
Start with some info & then with the questions;
About 5 years ago my son fell out of a tree at work & had to be life-flighted. He later found out his employer had no WC ins. He hired an atty & it dragged on for about 3 years; but his atty did keep in touch & answered any Q's my son had. My son did his deposition & was told his former employer will be doing his. But; now my son calls him & he's never in & he never returns any of my son's calls (this been going on now for a couple of months, but my son has not talked nor seen his atty for about 18 months --- when he did his depo). One more thing; when my son first hired his atty he did tell him his former boss is in the mafia-- my son's atty later did confirm this & stated that if we need any kind of protection or help; he'd be there for us. We can't get in touch with his attyl; just his secretary & she states she can't talk about his case at all. My son has asked to talk to any parallegal assts'; but the secretary says none are there. ***Do you think my son's atty was "bought off"??? Should we tell the secretary to mail all his records to us? (we moved across the state 3 years ago). Or is there something else we can do??? Thanks for any help--- I really do appreciate it. "Tomorrow is never promised to anyone" |

I suppose anything is possible, but what is more likely is that the attorney has decided he won't be making much, if anything on your sons case.
It is very difficult to find any attorney who will take a case when the employer has no insurance. Its sad, but true. Without insurance, many employers don't have the financial wherewithall to settle or pay any claim, and the attorney feels they will be wasting their time. The fact that it has been 5 years and we're not even sure the employer has done a depo would indicate that there may not be a solution at hand. You certainly can request his paperwork, and try to find another attorney. You can file a complaint with your state bar. You can file a complaint on the employer with the state, but after such a long time I am not sure if that would do anything. I'm sorry, but your son is in a bad spot, and there may not be an easy answer. "In the interest of peace, one should change their signature often" (or when threatened by someone who packs heat)

It's only my opinion, but if it were my Attorney, I would simply show up at their office and demand to know what is going on with my case. To me, that is always the best when you can't get the information you need.
You can also make contact with you State Work Comp Board, and ask them if they can tell what has been going on with such case. Five years is a very long time. Hopefully the Statues didn't run out on your son. Reply's are intended solely for informational purposes. your answer makes sense; we weren't really planning on getting another atty--- just thought maybe my son's atty might answer if we just say we were. I forgot to mention that his former boss had a $100,000.00 "cap" on his own ins. plan (regular ins--- not WC). So I was thinking maybe our atty just "shelved" our case--- but sure would of be nice if someone told us. ty Bad Boy--- How are ya?? Been along time --- I've off-line about a year now. My computer crashed & I'm on my nephew's (which won't be very often--- but will be when I can) Well; for showing up at my son's atty's office --- when my son got hurt we lived on 1 side of the state (of Pa) and then 3 years ago we moved to the other side--- 5 hours drive. For workers comp board---we have no case---former boss had no WC ins. But thanks anyway---you take care. "Tomorrow is never promised to anyone" |

I have found when I can't get the Attorney to answer me a certified letter works well. I also live too far from my Atty for a visit, just to check in. Have you checked to see if the situation would qualify for a small courts claim? Just a thought since there was no WC insurance.
