That depends on a lot of things, are you back to work? have you reached mmi? there are a lot of factors, do you have a lawyer?I think someone here can help you but need more info.

Yes I do have a lawyer and it has been 13 months with DR Care and no work and I was wondering how long dose the lawsuit take. |

wellllllllllllllllllllllllllllllllll some on here never miss a paycheck My husband was one of those....some on here have went 7 years without a check from WC......I went almost 2 years without one.....and its not a lawsuit.....you will not be paid for pain and suffering ........if you win you will be paid a portion of your wages if there is permanant injury you may recieve compansation for a part of future earnings
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

How long it takes to get hearings, then if there is more info needed another heasring will be scheduled. If you don't win at the first hearing it could take years and usually does. Can you give us more info? CAP God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |

this is a question that is hard to answer......how many licks to the center of a tootsie roll pop....but on the whole an offer is not made until you are at MMI or until your doc has released you and has said you are as good as you are gonna get...then an offer is made depending on your disabilty and your lost wages.....in some cases this is -0- dollars and in some it can be more.....there is not always a settlement.....sometimes you are just released and you look for a new job.....we really need more info to start such as your state you were injured in.....your injuries ...any surgeries? are you released back into the job market? what has your doc said can you go back to doing your old job we need alot more info......and no your lawyer knows about what your injury is worth but no one really knows for sure till all the paperwork is signed and you have a check in your hand.....

Julian.....I am going to try to be blunt without being offensive. First off your attorney is not suing for anything. WC pays lost wages. There is no "suing" for anything incuding pain and suffering. That being said I will second what Jayne has said. Sometimes there is never an "offer" made so to give you a time limit is impossible. In mine and my husband's case when the Judge decided in our behalf, won if you would like to use that term, first thing that was paid was our back wages. We were both paid back to date of injury less 20% (which is the limit in our state) to our attorney. My husband was made an offer 3 months later and settled a total of 5 months after winning. In my case I have been paid since 14 months after being injured and the Judge deciding in my behalf. That was a year ago. I have not been made an offer yet. There is so much to consider with a WC claim and without a state, injuries , treatment, etc or more info I don't know what else to tell you. Your best bet is to concentrate on getting well, going back to work if at all possible and listening to your Dr. Money is always something we think of as some of us go hungry BUT in the WC system with an injured body it shouldn't/can't be the sole concern. hi Julian,
Are you recieving weekly benefits from WC presently? You say you are receiving Dr's care....does this mean you have had surgery? What is your injury? We need more info to give you a better answer. As people above have said....not all injuries end with a settlement. One cannot sue their employer (only under certain circumstances) and simply getting ANY money out of the WC system, is like pulling hairs, one by one ! Good Luck, Lilly
