At what point???
When is it necessary to get an attorney? What can an attorney do for you? So far, the company is agreeing to shoulder surgery, it took about 3 months of ridiculous physical therapy before they finally did an MRI and scheduled surgery.

Now, the surgery is scheduled on a Friday and expected back to work the following Monday, for work and also for therapy ( with no pain meds, I might add, they said can't take em while at work). Actually, the nurse at work said I am to report to their office the day of surgery, afterwards for paperwork.

I lawyer can't do anything about the ridiculousness of this, can he?

i believe he can .my lawer makes it so i talk to no one ic work or employer,nurse manager. so on with the meds if they are needed and cant be taken at work then you should not be working .good luck

welcome to the site.i dont think you need a lawyer just yet they are taking care of you,ur bills so on.IF they stop taking care of ur bills or say they wont pay for surgery and dr bills then i would go talk to a lawyer at that point.as far as after surgery thats up to ur dr.s and any restrictions he gives you he may keep you off work or put you on light dutie work if the employer has any light work for you to do then you will have to try.ask your dr about the meds and work he may keep you off work for a couple days.its hard to say at this point you will know more after ur surgey.good luck and i hope all goes well.

Hi,
What do they expect you to do? Work in pain all day? That's ridiculous and cruel.
Has your MD released you to return to work?
Does your treating MD know that you are not allowed to work while taking the prescribed pain meds? If he does not...you need to inform him you'll be needing another non-narcotic pain reliever. He may even make you stay off work because of this non-narcotic work rule.

A lawyer can stick up for your rights and stop the B.S.
WC is complicated, and they only tell you what they want to (as far as your rights). You will also be releived of having to talk to people involved....the lawyer will do it!
What type of surgery are you having if I might ask....that you'll be returning to work after the weekend?

I don't know what type of Shoulder Surgery You are Having, but there has to be some Time for Recovery and Healing!!! You need an Attorney Yesterday if they expect You to be back at Work 3 Days after Surgery! You have Rights, and if You don't Protect them, No One Else will!! Get on that Phone and Find a Lawyer!!! (My Opinion Only, of Course!!)Wink

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!

I agree with getting the lawyer...becasue for all you know, they are not giving you everything that you are due. That happened to me and I went over a year w/ no lawyer, because they were paying all my med. bills and my rx's. But, when I did get a lawyer, come to find out...they owed me money that I did not know about and I had 6 mos. left, to file some papers with the state, or the case would have been dropped. (I would not have known this without a lawyer).

On the other hand, if you are not ready for a lawyer, I highly recommend at least sitting down and having a free consultaion. Prior to going for the appt. with them, write down any and all questions that you have and use the consutation as wisely as possible to learn anything that you may need to know.

I agree with the group. An attorney to me is a vital person in the WC system. Mine has removed so much burden from me. He always tells me to let him do his job because mine is to get well. Also after having shoulder surgery I cannot imagine returning to work 3 days later with no meds. I don;t take meds regularly because I am just really afraid of becoming addicted BUT I took them faithfully after my surgery. Best of luck to you. Welcome to the forum, come often and share or just ask questions.

as for returning to work post surgery or to HR the day of surgery, I think a lawyer and your doctor can help. As most of us that have had shoulder surgery can tell you, you will need the drugs for a while. make sure the lawyer is a w/c lawyer and talk to more than one before picking one.

I had shoulder repair surgery and I didn't really feel up to PT much less work. I was out 5 days after the surgery so a total of 7 days. But I was fortunate to have a job where I sit all day. The sling you will wear for at least 6 weeks.

I have what they call "frozen shoulder" and a bone spur so they are gone remove the spur and cut out all the scar tissue. Then force the arm to go full range of motion. They do have light duty were i work, and i understand tthat i need to get on pt asap.......because i dont want any scar tissue to form........im just worried about the meds........my work has a pt right at work.i was thinking with the meds..........at first at least maybe i could go through more motion and really it would help more.........Ive never had any surgery before so maybe im just worried for nothing. also some people i work with say you get a check after all is said and done is this true? They also said you have to sign a paper saying if it gets hurt agin they wont pay for it , if you sign they give you a chack .is this true....they did say that they can give me some kinda pain meds that i can use at work do these work ok 3 days after surgery?
