Employer lied to my attorney
I was hurt back in January of this year and my employer and their insurance company played games with me. I hurt my neck and went to ER and was placed on light duty. The games continued while I was working their light duty in tremendous pain and I finally got an attorney. After that I started seeing docs that knew I was not kidding. I had a herniated disc at C 6/7 that was operated on/ fused early part of May. Three weeks before the surgery, my doctor took me off all duty until further notice.
Two weeks ago I was placed on sedentary duty. My attorney contacted my employer to advise them of my status and they lied to him and told them I quit. Which I didn't!! Physician took me out work. They stated they created a job for me and trained me and I didn't like it so I quit. Question here has anyone ever been done that way by their sorry employer and is a lawsuit against them possible???? I cannot believe how awful employers are!! So I really looks as if they fired me then!! Bad enough to be in pain all year long, out of work for months barely making it on WC benefits and BAM no job. |

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

I would think you should be able to file something against them for doing that if you have the proof. It just does not seem like they should be able to do that to you. I would check your legal rights on that.

If You end up having to go to any Hearings, Your Attorney will have Proof from Your Dr. that You were taken from Work via Dr's Orders. Some Employers will try Anything to get Out of a w/c Case, but if Your Attorney is Paying ANY Attention at all to Your Case, which it seems they are, it will be Easy for them to Prove Your Employer Lied! My Very Best, and don't let it Bother You!!
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |
