My story(Knee Injury)
I was injured in Florida in August of 2007.
About a month later I was fired from my job due to me walking out even though i dont quite remember soing so.(But this is irrealavent) I did not have surgery on my knee until Feburary of this year. Before my surgery an X-Ray and MRI were taken. The X-ray was negetive the MRI showed brusing however the surgeon went a head and did orthoscopic surgery and found torn tissue in my knee. I have tryed to recover from my injury since then however I have been in as much if not more pain then before my surgery. I was sent for an FCE in April which I didn't find out until recently from the doctor that the the test giver said I was faking. I was unaware at the time of the FCE that I was supposed to do what the testgiver asked me to do even if it would cause me alor of pain such as crawling. After doing the FCE the doctor has for all intents and pruposes blew off even though my pain has not subsidded or gotten better and now mind you have not had pain medication for a while. I finally broke down one night and had to go to the emergency room as the swelling in my knee had gotten to the point where I was starting to worry about it. The ER doctor told me to just keep ICE on and put my leg in an immobilizer and put me back on crutches. Then today I got a letter in the mail that said as of June 19th(Which just happend to be the day of the appointment i had with the 2nd doctor who said he wanted to order an MRI on me) That I was at MMI with 0% disability. Now to elaborate on one final thing My primary doctor who did my surgery has not done another MRI or X-Ray since before surgery. I'm needless to say stressed and frustrated, I do have an attorney but need to know if anyone has ever ecountered anything like this and do you think I have any recourse in this matter. |

As far the FCE goes, yes you have to push yourself. If the FCE is done properly, they will be monitoring your heart rate at the time of the FCE. They will look at that as well as other things when they make the dermination.
As far as the issue of MMI. That will come down to a medical desicion. Chances are, the individual that did the fce is not a dr.. Your treating dr. will have to get involved and show medical proof that you are not at mmi. I am sure your attorney will handle that. 8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom. |
