That is exactly what I thought might be happening, since that is what happened to me. Except that I went over a year before talking to a lawyer. I had no idea of what I was due and was not getting, until I got a lawyer. The job and the i/c paid all my bills and they did pay me, but half of what I had due to me...they try to act nicely towards you, in hopes that you wont get a lawyer and they then can get a way with a lot of non senese.
I know it is a scary thing, but I recommend getting a lawyer, even if if makes your employer upset. You need to think of your well being. Best of luck! |

TJ, You may find this hard to believe, but to your employer you are a case number, and now that you are injured you are also a liability to the company, Your employer wants to save money , so getting you back to work as soon as possable healed or not serves that purpose. Don't be surprised and prepare for the worst, Termination......
Getting a attorney may anger them. But so be it at least an attorney is looking our for your interests. And you and your health come first..........Protect yourself. Thanks To all of you for responding but I have been feeling guilty too like it was my fault that I injured myself. I guess that is why I am still so far behind in this game.

It doesn't matter weather you feel guilty or not........... Your injury happened at work This makes WC responsable for your health care. That is why your employer is paying for WC insurance..
If you don't take care of yourself you can sure bet your last dollar that your employer will not care about you. And a few years from now when you are suffering from further injury do you think they will care if you hurt or not and if you receive the medical care you deserve.. Think again. Sorry to be so blunt, But you have to take care of #1 first and that is you. Life isn't about waiting for the storm to pass. It's about learning to dance in the rain. |

Please Listen to the Others who have Posted here, You are getting Years and Years of Wisdom from People who have been there!! My Case is going on 4 Years, and without an Attorney I would have Probably been Bounced out of the System a While ago, there are just too Many Laws to Follow, and they change Daily!! It's a shame to Say but what Tuffy Said is Correct, You are a Case Number and a Liability now, and You can Bet their Attorney's have seen Your File! Being in this w/c System for any length of Time if Problems Occur without an Attorney is Like taking a Knife to a Gun Fight, not a Very Smart thing to do!! Protect Your Self, if You don't No Body Will!! Best of Luck!!

I guess i need to act now because I still don't have a paycheck and ic has not called the lady from HR back to let her know why. I have been out 4 weeks today. I need some money.

tjw, you need to get a lawyer. The others are right, you may feel like you could have done things different and wouldn't have gotten hurt but the fact is you did get hurt and need the care and income. Since you employer has not seen to it that you have a check that shows he is only thinking of his company not you. It will take a lawyer a few days to get your checks started and may require a hearing so the soon the better. Call and set appointments with more than one lawyer and check them out before signing anything, then chose the best as they get paid by what percent of what you recieve.

I guess I am down to doing what I need to do. I am on my 6th week out still no money. I spoke with the insurance co on yesterday said it was mailed from MD. on 3rd, however I recieved a wage form from the on Monday. It was postmarked on the 3rd. I am going to have to call the attorney back.

The Insurance Carriers adjustors can simply call your hr dept, and request a wage statement be faxed to them. They would have in in minutes not weeks.

I would personally call the wc labor board in your area and notify them that you are still waiting to get paid. They will get information from you and the ic could possibly pay a fine for being late. I called my labor board when I had mileage reimbursement that was not paid to me within 30 days. You can bet that I got it right after I called and notified them.
When you go to the doctors, you should also be paid mileage. It is now .58 cents a mile. This adds up fast , and especially during these high gas prices. carpal tunnel recurrence/ neuropathy / RSD. 1/29/07 injury date. Permanent. PIR settlement 8/4/08 10% |
