Now is the time I would say you best get a lawyer. Get a WC lawyer that does not have alot on his plate as far as to many clients. One that maybe you heard good things about etc. My case is 1 1/2 yrs. now. I am going for my first hearing to dispute my rating and medication. I had no problem all the way up till now. you are at the point I started to call lawyers. I should have stuck with it as I did not follow through due to all the calls with no calls back when I wanted to go for a consult. I was in so much pain and WC wanted to find light duty for me out of my career I worked so hard for. I did finally go back one handed ( dominant hand was injured) and had the worse pain that my treating physician ended up pulling me out of work after 2 months for " overuse". My shoulder got so bad from protecting my hand that I ended up with shoulder problems and had therapy for almost 7 months. Now it is to late for me to go explain my case to someone. I will be all by myself in a few days to answer questions at my hearing. I really wish I would of listened to people here in the beginning. That is why I am taking the time now to tell you this. Please get some legal help now before you end up like me. Everything went fine till I had a dispute in rating and they wanted to stop my meds. carpal tunnel recurrence/ neuropathy / RSD. 1/29/07 injury date. Permanent. PIR settlement 8/4/08 10% |

Hi tjw1.
Call the treating doctor first thing Monday morning and find out if he released you to return to work. Working, or not working is only the doctor's call...not PT or WC. If in fact he has not released you, get it in writing from him (a doctor's slip), copy it & keep one for yourself, and take the other one in to work. If he did release you, you need to get something in writing from him (to CYA) that YOU weren't made aware of this fact...Keep a copy & give the other to your work. Also, no matter what they tell you at work (boss's & super's)...DO NOT go outside those written work restrictions, they cannot make you! Let us know how you come out. I need my money to pay my bills at this time because my job has already warned me that I will not get a paycheck for a while once I return and I have to pay for all benefits and insurance upon return. |

Welcome to the board and I am sorry thatyou have been dealing with this issue. I believe that if you are already having problems with the i/c, you should at least consult with a w/c lawyer. The i/c can often be late with your checks, but most states have a law that says how long they can be late, with out a penalty being assest to your checks. In VA, they have 2 weeks and then they have to pay a penalty. They have often been 1 2/3 weeks late, but then I finally get it

I am one of those IW who obtained an attorney before my claim was accepted or denied. It was denied. I won 14 months later. I was in so much pain, got such a run around trying to get treatment and felt I didn't not have it in me to deal with the IC also. I left that up to my attorney and have never regretted it. I have all the respect in the world for those who go it alone. I am not one of them, just not willing to put myself through the mess. I ended up having a breakdown anyway, so imagine if I was doing it alone. ![]() CAP God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |

i was injured 4-15-08 boss said who do you work for.when i told himm doc said no work for three wks. i immediatly got atty involved one hearing canceled another schelded next month wages still off by half lawyer says dont worry will get that rite soon also says dont talk to employer,ic adj,or allow nurse in dr visit keep in waiting rm. im in pa good luck use the counsel i stress that alot of laws and rules, less worries for u hopefully

if you mean your employer fire you.they could, they my already have that in mind who knows.alot of folks on here got the shaft after getting hurt no because they hired a lawyer and some got fire for hiring a lawyer.but they will never tell you that when and IF they fire you.you have to look out for your best intrest because they wont,the most important thing is getting you healed up and feeling better and all your employer wants is for you to come to work weather you hurt or not it all comes down to how much money they can save by getting you back fast.YOU need to heal.........good luck i hope all goes well.

They both asked why was I not getting a check because I have been out for more than 15 days already. I told them both that I was so lost and scared til I don't know what to do. |
