I had my impairment rating on april 18th 2008 now out of the blue my insurance company has approved my surgery which will be done mid july so do i still dispute the impairment rating now or after the surgery? i had already decided to dispute because i have only been off since jan-2008. i injured my low back and right shoulder. i have had 3 injections in rt shoulder and 1 in back. my rating was a 10 please advise me as to whats best .i would not wish w/c on my worst enemy.

it doesn't hurt you to file for a dispute now. this will ensure that you get a rating based on your disability after the surgery.

than does that mean that the insurance company will stop my mmi benefits and go back to paying me tibs again?

I always hesitate to predict what people will or won't do but since they have accepted the surgery as industrial you would be eligible for tibs and they should restart them once you go in for the surgery.

does anyone know how the mmi dispute process works in texas? do i need a lawyer since my case is fairly new. i am new at this and i really appreciate everyones help it is so nice to know that i am not alone and have other people on here to talk with that are honest! my doctor, me and my case manager all agree that i should not have been placed at mmi this soon, because the injection im my back was just done in may and it helped a bit, but this shoulder pain is horrible even with the meds.
