Question ttd repayment
long story short my ttd is not being paid by wc its a ins that my exemployer carried and i got appoved for by them.now if i win the wc case they want x amount back but i can not find that info any where in the paper work they gave me.does any one know how much they will want if i win???if i win ur talking over two years of wages they will owe me not including dr bills so on so forth.you all know what i mean all the bills......any ideas?i have not called the yet and dont really want to the two years is coming up and now they are looking in to exstending my payment longer just filled all the papers out and so did the dr about my condition,witch he put as unchanged meaning im the same as is was when i got approved by them in the begging.thank all for any help.

Hi hurt.
i know in my case & State (Michigan)....I received TTD until I was through the VR process...then it changed to "Permanent Total" . As I understand it, only once you are receiving PPD, or Permanemt total, these are the ones that come out of your settlement....not the TTD.

thx lilly they alos say that if i get ssd first they will take there money out of it or if i win wc they take it out of it i just dont know how much they want back.

hmmmm... i also get SSD, and i do not get my full amount (it is offset) because I am receiving WC at the same time. remember, at tax time they can't touch the WC. If you do end up approved for SSD...they will send you a letter stating the amount you will get monthly, and they will also tell you what you should get if you weren't already receiving WC.

I have a question too about this subject....
If one has had surgery during the course of the wc injury....does the surgery worth come out of the final settlement too? In other words...if one settled for 180K, does the cost of past surgeries related to the injury come out of this too? If so, I'll owe them!!!!

Final settlement is for any past benefits that were not paid and for future benefits (medical or wages) that might be owed. If they paid for the surgery, then its done and paid for and has no bearing on settlement.

lilly i know my lawyer is going after med repayment seperate from the money they owe me in lost wages they didnt pay,meds i paid for,milage,and what ever else.he also told me that if i get my ssd before the hearing that it makes my chances better of getting life time med on my back because its showing me as disabled.if i dont win it before the hearing than it will be harder to get life med on my back.so ur med should not come out of ur settlement.for me the bad thing is i will have to repay so much ttd back to the ic thats paying me and i have no idea how much that will be.

Hurt....I do not think you have to pay the TTD back....you only have to pay the PPD or permenant total back.

If I'm understanding correctly hurt is being paid by another insurance policy not WC. (some type of disability policy that the employer had). If that is the case and hurt wins the WC, the other company would have the right to recover any money they paid out. Usually, that amount would be reimbursed to them either directly from WC or from the money hurt receives. However, since hurt has already received the wages from the other policy, that money would be figured in to whatever amount he would receive. It wouldn't actually be "paying them back" it would just be a transfer of funds from WC to them. Nothing our of pocket.

kate that sheds more light on the subject for me but are you saying that me lawyer should or could ad this amount to the wc case when it goes to court?other wise would come out of the final settlement?
