RE: Who makes the determination for TTD?
1171 Wrote:you can file directly with the BWC I called the BWC about a half hour ago and was told I could do it over the phone since my employer is "dragging their feet". I have a claim number now but was told by the BWC that now I will be waiting on my employer to dispute this. They have 30 days and after such a time a hearing will more than likely be scheduled. If they dispute the claim...which the IC has already told me they are...NO BENEFITS, NO MEDICAL BILLS WILL BE PAID UNTIL THE HEARING COMMITTEE MAKES A DETERMINATION. I found all of this out by just talking with an ombudsman at the BWC. They were very helpful. I am going to go talk with my employer this afternoon about the FMLA. I still think it's kinda early in the game to involve a lawyer....my employer isn't disputing the fact that I have the carpal tunnel....they think I had it prior to my employment with them. The BWC has told me that it doesn't matter with carpal tunnel..... Life is what happens to you while you're busy making other plans. |
