This was on off topic and I thought it may be better answered here. It was written by chriswhovian.

My case has been taken and I am receiving weekly payments from the carrier. I am currently out of work on doctors leave.I have a lumbar strain and bad disk, with disk disease on multiple levels. I am waiting on approval for pain mngt. My Att. is great. However my work is making it a bad enviroment with rumors and such.I can have my lawyer say something to H.R. but that would stir up a big mess. Since Im in a right to work state, can I just quit without it harming my case,since i am already taken by a carrier?

In my opinion, I would think even your Attorney would advise not to quit at this time. For at some point, when your asked or told to return to work, it would help the process to see if you could work without further pain concerns. Have you quit, you would then need to find work that is within your restrictions that your doctor would or should advise you of. The process of looking for new employment may also be harder than hanging on to your current job at this point.

But can you quit? Yes, just like your employer can fire you, for something other than your work injury.

You should be advised to talk this issue over with your Attorney also.

It would be so much wiser for you to stay where you are while this is going on, if you are receiving workers comp you might want to check and see if now is the time to take FMLA its 12 weeks as needed for recoup but be sure first to wait and see if you need surgery cause that would take longer for recoup and you definoitely
would need it then . Has your doctor given you any idea what is going on and what he is anticipating what is going to happen?
I mean does he expect pain management to work before you can go back to work?
If you quit you will lose all that is happening right now, ( no money honey and no help for your pain)
and the heck with those damn rumors, I had it too, but I did have a few good friends stick up for me....Unfortunately tacky people will always spread rumors so you have got to do whAT is best for you and not them. You have to take care of you that is your First priority......
And I hate to be the one to say this but if this is going to be long and involved the company will probably terminate you, thats why I
suggested the FMLA it will hold your job for 12 weeks, they have to give it to you ,but you have to ask for it.And if they terminate you your workers comp will still go on as long as the doc writes that note
you can not work at every visit.[attachment=734]
