I am currently out of work, on doctors orders, with a lumbar strain and a bad disk as well as disk disease on multiple levels. I am already being paid my weekly benifits, and my case is under a carrier, thanxs to my attorney.I am waiting on approval for pain mngt. My work is spreading rumors and lies from H.R. to employes, making it a bad work place, without me even there.Since its hard to really prove it, and getting my lawyer involved is really out of the question, could I quit. My case has already been taken, and I live in a right to work to work state,is it even wise as far as hurting my case?

Sure, you can quit. This is America, you are not a slave. Don't be surprised though if they don't send you another paycheck. On second thought maybe you should discuss this with your attorney first.

I'm going through the same stuff I messed a couple of days but my body be sore the Administrator looks @ me funny and the employees think I 'm doing it for money so f them I miss working but if my body cant take they cant make me its the summer I love life this is my time I have no money now so kick rocks job

You could quit, but I think that's what they're hoping for....why give them what they want? The same thing went on when my husband got hurt. Ignore it all, those who know you will know the truth. What else matters?

You can quit, you are not a slave as said above, however, if you quit and you are on light duty which maintains your physician restrictions then you are jeopardizing your monetary benefits. You will not recieve any TTD if you are recieving your money through light duty versus TTD. You should maintain your medical benefits however. Also you mentioned you have a lawyer, have you talked to him or her about what is happening at your work environment? He or she will most likely say you are now in a hostile environment and start another claim on your behalf. I think your best option is to remain in your job, talk to your lawyer, document daily time, date, and what was said and who said it too you etc. Rumours in a facility are deadly for an organization so I would not think that the Administrator would tolerate that sort of behavior of his or her HR person. Also have you read your employee hand book? It may give you some more infomration on how to handle this situation in your best interest. Good luck Red

I agree talk to your lawyer. That is what you are paying him/her for. When it comes to dealing with WC I would contact my lawyer before making any move......Good Luck BA

I agree with the rest. You would lose your benefits from WC if you chose to quit your job right now, but will still have your medical care taken care of. Just no weekly pay check. If you have a lawyer then they should be able to file something against the comapny for harassment.

You should not be in a situation like that when you have to work with your injury. Alot of cases usually end with the employee either finding another line of work wiithin their restrictions, or hopefully going back. I was at a place for 15 yrs. and when I left my place of work with my injury, my doctor then put me at mmi. This new job is much better pay, but still miss my old line of work, but this new job is within my restrictions , so it is much easier on my injury. Read the top of this forum under your " State" for more info on what your rights are.

it doesnt matter that other people say or think.like the others have said talk to ur lawyer.what really matters the most is that you get ur self taken care of so nothing more gets injured........

People can be Very Small when Someone is Injured, don't let them Bother You! Ignore them until You are Well and Your Case is Over, and then Find other Employment. Your Attorney as others have said is the Best to Talk to about this, but I heard some of the things Folks at Work Said about Me after I was Injured, and even though it Stung, I just wrote it Off to Ignorant People with a Small Mind!!Wink

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!
