Hi,
I have ************ as my wc carrier.Sad As i stated before my adjuster is a real bi$*% to my atty and has been very rude to myself in the past. she is very lazy and slacks on lots of requests even ignores them. and will never settle my case. Im not being a cry baby about it. Ive been treated worse but this lady is very unprofesional. Is there any way to get my case off her hands in in another adjusters? If i move from NY to FL will my adjuster change then. they are currently out of rochester ny. i would just feel alot better being out of her slimy hands. Cant wait for this to be over.

Hi frfghtr,

I would think that your attorney has the power to have the adjuster changed. Possibly he enjoys arguing with her crap attitude, or is using her nasty personality to your benefit, when she exposes her 'true self' and makes an (Jayne's lame attempt to bypass the Bad Word Filter) of herself in court !

you can file a complaint with her supervisor or the claims manager but other then that there is not much you can do.

I had an awful adjuster for almost three years, who wrote long letters to my physician demanding this or that, finally physician got tired of it and quit me. She also denied me all medical care since 2006 and took back previous payments from surgeons, doctors what w/c authorized before. When I called her, she yelled at me and accused me of doing things at home to make my hand condition worse. When the Voc Firm whom she hired to get me back to work recommended pention, she changed the report saying "voc counselor no longer available" and hired a second firm. (I am lucky, the owner of the firm contacted me upset about this and gave me original report). She instructed this second firm to get me back to same type of work where I was hurt and spent additional thousands of dollars for nothing, as I am permanently restricted doing this type of work. Sometimes, she held back my checks for no reason and I had to call w/c and spoke to someone else who released my checks as there was no reason to hold them.

I believe they assign these evil ones to those cases what they want to close quick and they try to bully us into quitting. I ended up hiring a lawyer because I just couldn't deal with adjuster any more and even lawyer said, never had anyone as mean as this one. When I tried to complain to her supervisor, she just ignored my calls and never returned it. When my daughter whom I authorized to deal with them called adjuster questioning why did she recoup previous payments from doctors, she also yelled at her.

Finally, just a few weeks ago, this adjuster was taken off from my case and now I have a different one. This one I hope will at least go by the rules and will not go out of his way just to cause me grief. Just keep your cool and hang in there, moving will be foolish because of her.

Hummmm, why not have fun with the Adjustor, and take her/him to small claims court, for un-do and lack of proper medical and what not????

you can also file a complaint with the department of insurance or your state legislative representative. usually either one gets passed down thru upper management for a response

Bad Boy, can you really take adjuster to small claims court? I know mine caused me a lot of stress due to her actions and denial of medical care. I might do that when I am in a fighting mood again.

Although, if she has a nervous breakdown again just as she had two years ago, it would be enough punisment for her. I know I don't envy her job and probably they take some abuse from upset claiments, maybe that's why some of them are so mean. 1171, please don't take it personally, I know there are good adjusters and bad ones, just like in any other profession.

I still have some questions though. So who should complain about her ? I have an atty that tip toes around her. When i get mad i sound the horn and raise the flag. Since i have an atty that doesnt permit me to contact them correct ? I wouldn't be moving cause of her but would deff consider it in the pros oppose to the cons of moving. Would the adjuster change if i did move.

The adjuster would most likely not change because the claim is still handled under the state you were injured.

Call the supervisor or claims manager and if no results, follow 1171's advice.

You wouldn't beleive how fast some supervisors move when the "big bosses" get something from the state!!

Frf, the Very First thing My Attorney did when I Retained Him was to Send a Letter to the Adjuster, NCM, and All others Involved in My Case that they are not to Contact Me, and had to send any and All requests through Him. He actually made it soo Hard on My NCM that Concentra quit Sending a NCM to any of My Appt.'s. I haven't Spoken to My Adjuster in almost 3 Years, My Attorney handles it all. Just a thought, and I Hope things turn around!!Wink
