sick pay for md appt
Hi I'm in Minnesota. If my work comp is sending me back to my MD for follow up and it's 2 1/2 hours from my current home (I moved since being injured, as originally planned, after taking this position), is there some law that says I can't use sick pay for that appt day?
Also, can the employer insist I make up that day on Saturday, which currently my days off have been Saturday and Sunday?
I am restricted to 40 hours a week. With this Friday off for the appt, I will be at 32 hours.
My problem is my neck injury does not like driving. I am telling them I cannot tolerate that much driving up and back and then work the next day. My MD said once I got moved he would refer me to an MD where I am living so I don't have to keep coming back to him.
Work Comp insists on me going back to him. IME came back with for sure diagnosis that finally gives me info on what is wrong with my neck. She gave specific treatment advice of which I agree with for the most part, but am nervous about. Work Comp insisted I schedule this appt last week, I think Wednesday and would not allow a referral. Today my boss calls me and asks when I plan on making up that time. Even though I had already told her I would be using a sick day. She said HR doesn't allow a sick day for work comp appt.
I think something is wrong with all this. Also, I don't have anyone to stay with my children on Saturday. We are still int he process of moving and my husband will be gone to the old house 3 1/2 hours away.
I think I should be able to use a sick day and call it even. I am not the one insisiting on going up there to the doctor.

anyone out there have a guess? I have to have either 1) a dictated note from my MD by tomorrow close of business day or 2) I have to make the drive back home and work all day Saturday. I dont' know how they can inform me of this at the last minute.

I have a guess...I would think you can use sick time...If you get a doc note then that should be sufficient for HR dept. Not sure of the law, but that is what I thought sick time was for...being sick and seein docs right? Good luck with this and keep us posted. Smile

I'd be looking in my company manual about their sick time rules.
This sounds ridiculous to me too. But after one gets injured it's not uncommon for one's place of employment to get picky and nasty.
Use a vacation day if you have to.

Also, don't forget to keep track of your mileage both ways to MD appmnts, and turn it in to IC for reimbursement .
