My adjustor finally brought up settlement. After seven years on and off comp, many IME's and much BS, maybe, just maybe I can escape this screwed up system. They want me to make an offer. I thought that was weird. I beelined it to the lawyers office, but wondered if anyone else had this happen to them.

just because they offer one doesnt mean its good for you........they will lowball and it may go on for months and even after you agree if medicare or SSDI is involved it can take many more months.........

Yes this happened to me too. I also thought it was strange, but lawyer was not surprised by it.
IC contacted lawyer last year with intrest in settling, but never mentioned an amount. WE entered the first amount, and of course it was counter offered with a much smaller total. We never re-entered another offer, as we're sticking to the original plan. Things were in limbo for many months....now we recently heard from them again, and the medicare set aside is in action, but at turtle speed because of the SS back log.
So, this is where I'm at right now.
If you're thinking that settlement is going to be swift...it surely isn't in my case, and i think it's pretty lengthy for most people in our situation.

Been reading this post and have a question, If the IC is talking settlement and doing a medicare set aside does this mean they are stoping your w/c checks?

so far it hasn't happened (stopping paymnts). Although my weekly cks are PPD...so this means I'm being sent part of my settlement every week.

Calico-My lawyer was the 1st person to bring up a settlement. She asked me if I wanted to ask for a settlement or to wait out my time? When we discussed the pro's and con's, she did say that the amount that we ask for first, they will try to ask for a lower amount. So, I told her to put in a number (I'm leaving that up to her), but I told her to add in the amount that she would be getting and then a little more. That way I have room to come down. I don't know how that will go over or if W/C will even except any type of settlement, but that is how it went with me.

Jazzi-For me, I was told by my lawyer, that they will not stop my payments until they either, get me a job that pays what I was earning, begin receiving a settlement, or my 500 weeks ends. (This is for VA.)
