RE: Worker's Rights Question
Tweety, are you ok? I've noticed a change in your typing and attitude of late. (I do not mean that as a shot. I am just concerned)

Might be my imagination. Hope everything is alright.

RE: Worker's Rights Question
Thanks to all of you who addressed my questions. All of the rules for comp. and my rights, are still new to me. I am trying to get an appointment with a lawyer (to make sure I know my rights) and I will also get a note from my doctor to address the amount of hours I am allowed to work in a shift. Hopefully I can get this all straightened out. Again, thanks for the advice.

RE: Worker's Rights Question
The job offered does not have to be at the same skill or pay level that the worker was doing. If it is a lower paying job, the worker continues to receive benefits based upon the difference in wages.

RE: Worker's Rights Question
Question........I start light duty monday counting nails and shredding paper for 8 hours in 30 min time frames for a max of 3 hours each. If I am in pain and cannot make it through the full 8 hours, will my work be able to fire me? W/C to not pay for med treatment? I am going to do my best, but I know how much pain I am in. Plus WC has not even authorized my dr to treat/diagnose my back pain and carpal tunnel. Any thoughts?

Thanks all!

RE: Worker's Rights Question
People like to think of Dr.'s restrictions as a dark line in the sand, where working within the restrictions will not aggravate the injury and working one bit over the restrictions will cause irreparable harm. The truth is that the restrictions are the Dr.'s best educated guess about what can be done and not aggravate the injury. There is hardly any evidence-based research to guide Dr.s making restrictions. Just their practice and experience.

I say that to explain to you that if you would have trouble at work, it is not totally surprising. If you do have trouble, notify your supervisors at work immediately. You should also request immediate medical evaluation, preferrably by the treating Dr. so that the restrictions can be reviewed and adjusted. That should preserve your right to benefits.

I will also say, that even though setting restrictions is more art than science, it's important to stay within the given restrictions at work and at home. The Dr.'s guess is probably better than anyone else's.
