Home Invasion By I/C
I received a letter a couple days ago from my atty. I am to appear in court in the first part of July. The I/C wants to enter my home for inspection. The I/C is claiming now that my disease was caused by something in my own home. I think this is absurd but if I refuse to allow an inspection it would look as though I am hiding something. It has taken quite sometime for my health to improve with many setbacks due to relearning what my body will tolerate now but is steadily improving. Aside from the maintenence drugs I have to take now it has been 6 weeks since my last round of antibiotics and steroids. If there was a problem with my home my pulmo says my wife would be sick and the cat would be dead. Sorry I posted in the wrong area . I did not notice till it was too late.

What does your attorney have to say about all of this?

What next? Will we all have to turn over our personal computers to defense, or will they come in and inspect our medicine cabinets? Maybe this is more common than I am thinking, but I've never heard of such a thing.

If you do allow the Insurance Carrier Representatives into your home, then it might be advisable that you and your lawyer also have your own expert there along with theirs every step of the way. You and your lawyer need to know the exact credentials of the "inspector" beforehand so that yours will match his/her expertise and able to counter any findings that may be absurd.

May I ask what your injury is that is causing them to come inspect your house?

carpal tunnel recurrence/ neuropathy / RSD.

CD....Wink is dead on. I'm sorry I didn't think of it even knowing that whatever "expert" the IC pulls out of their hat you are entitled to having the same. Do you have an attorney? Sorry if you told me. I'm sure there are certain known allergens and irritants they're looking for. I am wishing you the very best with this but please check things as as Wink suggested. I know my attorney has back up for every one the IC pulls out of their hat.

Thank you all for your input. I am honored to be a part of this site.
My atty. has not even called me yet and that upsets me.

Here are links to The American Lung Assosiation with explanations of my occupational diseases (occupational asthma and hypersensitivity pneumonitis) of which my pulmonoligist diagnosed me with. I also have COPD and some emphysema also. I have hesitated for quite some time about really opening up on this site for fear that I would be looked upon as one of thoses comp milkers because of the nature of my comp claim.

CD, if You were Diagnosed with this Condition after they were Cited by OSHA, it should be Clear Cut that this is Work Related. If Your Husband is Well, and without Lung Trouble, that should Prove it without a Doubt. If Your Condition was Diagnosed before they were Cited, and Your Husband is Well, that should also Prove it's not related to Your Home. My Opinion Only, but No ONE from the i/c would ever enter My Home without a Court Order from a w/c Judge, and My Attorney and Expert would be by My Side as Wink Said! It's not Your Job to Help them find a way to Deny Your Claim, make them have to jump through all of the Legal Hoops they Make Us jump through, and only allow them in if Forced to. This is pushing the Limits in My Opinion, any so called Expert Bought by the i/c can Make any Report look as if the Problem is in Your Home!!Wink

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!
