Job filled
I have been off do to a fall. I had surgery to my right knee, but after returning to work my knee started swelling and I had to take off again.
When to Dr. said I could go back to work after 4 mos. I was told my job had been filled. Where do I go from here. tronic |

you should find new employment.
depending on your state there may be some additiional permanent impairment benefits but it won't be enough to live on. |

Thank you for your reply. I did not know they did not have to hold my job. I thought they could not fire you if you were hurt on the job.

you have upto 12 weeks of job protection if your employment is covered by the Family & Medical Leave Act.
filing a workers comp claim does not give a worker immunity from termination or layoff. |

depends on your state here in okla they have to hold your job or did when I got hurt we have new laws every year to tighten the screws on the IW
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....
