First post here, I have really enjoyed finding this site and reading about w/c experiences "other than my own". Seems like a friendly bunch here, hopefully i will fit right in.
And now, my first question,Tongue
Once you have exausted your fmla, and company has been covering insurance premiums, if you are terminated is your employer or the insurance company within their rights to sue you for the money paid in? Im curious because i recieved a letter 2 days after my injury stating" upon your return to work any missed premiums will be taken from you first check, since your account has gone into errars? make sense?

I had gone way past my FMLA in NH , and when I returned to work I was told that each week they would take a certain percentage of my check to pay the insurance back. They never did. I worked for two weeks on light duty and then gave my notice.

I received a letter about cobra and I was already working at a new job when I received it. I have been gone from that employer since Oct. last year and have never heard a word about having to pay it back. Different companies may have different policies.

carpal tunnel recurrence/ neuropathy / RSD.
1/29/07 injury date. Permanent. PIR settlement 8/4/08 10%

I also never had to pay anything back, but then my claim was at first denied and when finally accepted WC had to reemburse my ins co.. I also think it depends upon your co policy...

Hi.
several yrs ago , I had a big surgery where i was off work, slightly over a year. What my company did, was have me pay my weekly insurance premium (I paid once a month) while i was off work. This same senerio played out again when i was injured and never returned to work. Once I was at MMI, I was terminated, and my insurance simply quit. Since i kept up with the monthly premiums all along, I never had reason to pay anything back.

Hi GOTPAIN and welcome. Hope you stick around, we are a great bunch of people and some are so very knowledgable. JMO but I think it is up to the employer. It depends on what their policy is. I have never heard of reimbursing any monies for the 12 weeks on F
LA BUT it's possible that afterwards could accumulate. I say this because my companie's handbook states in that they will pay the premium for all IW for a peiod of 3 years or until they return to their pre-injury position. Now that's my employer. Maybe yours has a different policy. My attorney has told me that if there is a policy or it's written in a handbook then it's legal. I'm wishing you the best.

Your best bet is to call the head of HR or Personell dept. where you work, and ask about this. In case they do want you to pay for monthly insur. premiums, I'd rather pay by the month...instead of letting it accumulate, and have to pay a big one in the end.

Thank you for the advice everyone. I got the letter today stating they are canceling my health insurance, but I will have the option of the bargin priced cobra,Tongue. Oh well. As for contacting hr, once someone gets hurt here, you are permanetly blacklisted. No one really wants anything to do with you.
