Thanks Deb that puts my mind at ease just a little.I new nothing of this so i am writting it all down.You seem to know alot about this and i appreciate the help since i have just started and cant make sence of any of it.

Hi wcrazed1975... thanks for your response to my note to you. Through all of it, and it is a rat race of calculated thorns by W/C, do not give up just as lilly I believe said. Hang in there. You have been given some good information and I know you will follow through, however, do not forget the lawyer, and as was said earlier, the lawyer doesn't earn a penny until he wins a case for you. The % of paid to the lawyer is based on your states regulations about W/C issues.
You write as through you have a great support system above us. I am glad. I also believe that God does not give us more than we can handle. Stay on this forum and you will find that we all have learned a lot about from each other and we all receive a lot of support that helps us to get through all of this mess. It is a shame that you go to work to earn a dollar to support a family or just our selves and then you are hurt and now you are left to wonder how you will pay your bills. The truth is, if not for my retirement, my husband and I would have bottomed out also. I hope you have someone who can assist with it all. Also however, the lawyer could file the courts for reconsideration of what the W/C IC did in terms of cutting you off after just a couple of days. Of course you will have no vacation, sick time to help get you through, and if the lawyer tells you not to file for unemployment weigh that suggestion based on your immediate needs to live. Ours did say that, and after all and all, all we did was postphone obtaining our disability insurance that is given in NJ where we live and then his unemployement for the next 6 months. He obtained less in a settlement than what he would have obtained through the other systems. In terms of could you loose your job, that may happen based on the number of days you have been working, however, the company you worked for would still be liable for this situation. Find an employees hand book and read it good, take it too your new lawyer, and have him or her see if he or she can find a loop hole there. I wish you lots of luck. To answer your question, Del did not ever return to work. Technically, he has never been released to return to work. I have Multiple Scolorosis and am considered a disabled Vet, so we both have income and health care...so we are luckier than most. He has been in college full time and will graduate in early September of this year... Also, ifyou are not receiving enough income don't forget about any state or county services. While if that were me, I would have a hard time doing it in the beginning, however, you will most likely change your mind over time... good luck to you ... I wish you the very best. Red 1030 Thanks so much for the kind wisdom i hope you are well also ,my sister has 4 boys and she has Ms so i have an idea of what you go threw it can be quite overwelming. I my self have had lupus since i was 7 years old and the older i get remission seems to get further away, and at 33 with a 12 year old son sometimes i dont feal like the worlds strongest dad but he understands so i cant complain.Honestly you dont think about this sort of thing till you find yourself in it.Now i just want to go back to work and provide for my family but it is painfull and i wish it was all over but i am smart enough to no that it has just began and there is a long road ahead for me, but it is not the end of the world and there is a light at the end of the tunnel so i have to keep moving toward it till i get to where i need to be. This forum has made me see that much.

Hi wcrazed.......Just my 2 cents. I have a cervical and left shoulder injury. 2 years later I still have Dr.s scratching thier heads and to which body part is causing which symptom. They are very closely related. You really need an MRI of your neck and shoulder to have a clear picture of what's happening. In my case both were damaged goods. Also as far as an attorney goes mine put in his petition that if I won (which I did) that ALL costs would be paid for by the IC> The only thing I will owe him in the end for his hard work is the 20% that is the maximum on a WC settlement in my state. I too was only on my job for a month when I got injuried. I had taken the job as it was in management and a new challenge for myself. I was laid off in the Mortgage industry as I was an underwriter I was making about $10 less an hour at my new job but it was an interesting job and new career. I suggest you keep a daily medical log of how you feel and everything you do etc. You can review it and tell yourself if you are getting any better etc. Make sure you write down even if you took out garbage etc. They ask you questions about it all if you have a medical deposition. I felt like I was a criminal being interagated with no help from my attorney. Do your research on an attorney. I happened to have a bad one and have to fire him. Most in my state work on contincency where they only get pain if you do. I even found an attorny lead from others in this forum. I am sure this is going to slow things down for me getting a new attorney but I will not deal with this guy any longer. My claim was accepted but they are dening me any treatment or time loss. But yet I spent 8 days in the hospital and could not work and ended up back in ER almost 2 months later.They are also denying most of medical bills including the face and neck x-rays. I was hit in the face at work so not sure how they can deny the x-rays. Welcome to the forum. I can tell you I have enjoyed talking with others and getting great advise here. Keep us posted on your condition and do not get down stay happy and positive. |
