Sad HELP I am lost
SadI was told by my chiropracter that he was not being paid so called the lawyer and explained what was going on and she said that they are denying care now since jan 1 2007 and there resoning is that the ime doctor suggested pt but know were in the ime results did it say i had to stop chiropractic. The lawyer says all they can do is set up a hearing date i have no prescription to go to pt and the chiro i was going to has recieved no letters stating i was cut off nor did my lawyer so now i am stuck. This is such a frusturating situation and i dont know what to do the chiro was the only dr i was seeing and he had me in a stable sitiuation with my back iwas not getting worse and was finaly able to be up and moving around.. I think insurance is trying to sever my ties with him because he wont tell them i can go back to work. I was a appliance delivery person which requires me to be able to lift extremely heavy items for 10-12 hours a day i can not walk a 1/4 mile to the store on the road with out my back getting extremely aggrevated i have a herniated l5-s1 disc. I feel like i am going to get screwed here very shortly i think it is time to look for a different lawyer i need a shark not a gold fish. thank you for listening any info will help.

What state are you in? How long have you been off? When was your RME? Are you collecting loss time benefits?

please we need so much more to try and help.....and please know there are some really wise people on here

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile

soryy i am kind of new to this my ime state si have a herniated disc in the l-5 s-1 and it is pinching the nerve sac causing sharp pain down both my legs to the knee and some times into the calf . also occasional lower back spasms imean 2 -3 tome a week some worse than others.

I am not sure why there is such a lack of communication with the IME and the adjuster and your lawyer- 5 mos. later you are finding this out is bizarre. And why has the chiro been treating you all this time ? without pay? Something is wrong here. Your lawyer certainly -in my opinion- is NOT doing thier job- who got a copy of your IME? If your lawyer  did then what have they been doing all this time? nothing apparently.

But personally I would have had you seen by an ortho within the 1st 6 weeks of the chiro. got you to the correct profession and made sure you were getting the right treatmnet- Chiro have some place in the med field but in my 32 yrs experiance I know only a handful that would treat properly and know when to have the patient move onto a specialist. What diagnostic test have told you about your herniated disc?

Sorry I do not mean to sound angry and especially at you- But it truly pi$$e$ me off to see an IW treated like this

I hav eheard the same thing and this chiro has been great and he would still treat me but the lawyer has basically made it apparent that there not going to try to help get this tacken care of the just set up another hearing . I was unable to even get up and move around 6 months ago now i am up and about but need frequent rest the ime doctors i have gone to one chiro one ortho th e chiro agrred that chiro was a good choice for care the ortho tried telling me that i dont have a herniated disc and i think was not in a good mood because he had to travell 75 miles to one of his offices during one of the big snow storms and put his car in the ditch 3 time he actually told me that and gave me a a partial exam then while talking to him he states i cant stand or sit for any length of time. I get the report and it says that i can lift up to 25 pounds and that i need to see pt then orthopedic surgeon. I also saw a neurosurgeon he says i have no herniated disc i have degenerative disc disease I am 27 years old and have degenerative disc disaese i cant waite to see how i feel in another 20 years if i feel like this now.

Each state has their own laws that control workers comp.
what state laws are you under?
since treatment is being denied by comp you should be eligible under your health insurance until liability for it is decided. If you haven't contacted them yet do so and find out your alternatives. will they cover your chiro care? if not do they have a chiro in their plan who is covered? can you transfer care to another doctor in their plan?

some states have fast track or expedited court procedures for denial of treatment issues - does your state?
what do you know about your state comp laws?
sometimes the employer as the policyholder can get carrier attention faster.
Do you still have good relationship with your employer? will they contact the carrier on your behalf?

P.S. I didn't see your other thread. you are under new york comp rules so you may have to wait awhile for a court date.you don't have to answer in a separate thread. it's easier to understand if you keep to the same one.
